Typically, the DPA requires the defendant to perform 32 hours of community service within 4 weeks.  Conditions of release also usually include drug testing UNLESS you tested negative in lockup and did not admit to using during the Pretrial interview.

You will also need to provide verification of employment OR if you do not work you need to consistenly provide proof of you looking for employment.  Obviously PSA (Pretrial Services Agency) will take documented proof of disability if you claim that.

On Prostitution and Solicitation Charges in Washington, DC
June 27, 2011

There is no question that many people get arrested in Washington, DC each year for crimes involving prostitution. One common scenario is for a man to get arrested when trying to pick up a prostitute who actually turns out to be an undercover vice cop with the Metropolitan Police Department (MPD). In this case, the charge will normally be solicitation of prostitution. In Washington, DC, a prostitution charge carries a maximum of 90 days in jail and/or a $500 fine for the first offense. For second and third offenses of solicitation or prostitution, the maximum jail time and fines increase. A third solicitation offense in Washington, DC is punishable for a maximum of 180 days in jail and a fine of up to $1,000.

As a Washington, DC criminal defense attorney who represents people charged with solicitation and prostitution, one of the biggest concerns is not always the potential penalty, but rather the possible embarrassment, employment issues, and whether the charge could affect one's security clearance. While a solicitation of prostitution charge is a misdemeanor in Washington, DC, it is certainly one that many people would not want to have on their criminal record, and this is understandable.

Some of the things your lawyer can discuss with you are the ways in which your case may be resolved without a conviction on your record. Your attorney may be able to negotiate a deferred prosecution agreement (DPA) where you agree to pay some fines, do some community service hours, and stay away from a particular area. If you complete the requirements of the DPA, your attorney will go back to court with you and the government will dismiss the case against you. This is only one example of how your lawyer can assist through this unpleasant experience.

You should speak with your attorney about these concerns. You should hire a lawyer whom you trust and feel comfortable talking to, who will listen to your side of the story, and who will treat you in the respectful and professional manner you deserve. Always remember that an arrest is not a conviction.

If you get arrested for soliciting a prostitute or visiting a bawdy house STFU and call your attorney.

If you don't have an attorney find one.

You are innocent until proven guilty in a court of law.

Your attorney can likely have the charge
reduced if you are willing to do community service.

Don't be a snitch.

So we need to stay away from Dupont Circle?

I don't see anything in this blog posting which stands out as unusual, and certainly nothing that identifies Dupont Circle or other D.C. locations as particular hotspots for LE activity.  Stick to the basics - visiting well-reviewed providers or agencies who screen, avoiding the unreviewed high-traffic BP girls who shuttle guys in and out so quickly that it's obvious what they're up to, and following the practice of STFU if you do get caught.

I've read on another board that there is plenty of streetwalker activity in D.C., some of it in downtown D.C. strangely enough, so maybe the stings this blog describes are aimed more at that activity?

Definitely STFU. That's my plan if, God forbid, I do run into LE.

And if I ever need a lawyer, the article's author might be who I call with my one phone call.

BTW, I was only joking about Dupont Circle. That's the only place I've ever been to meet someone in DC.

But if anyone does know the area he's referring to, please PM me.

Thanks and be careful out there!

"...deferred prosecution agreement (DPA) where you agree to pay some fines, do some community service hours, and stay away from a particular area. If you complete the requirements of the DPA..."

I don't think that means everyone should avoid a particular area. ie: DuPont Circle
It means that if your arrested in a certain area, your DPA conditions will be that you stay away from that area unless you work or live there.

This whole DPA thing is great from a criminal record standpoint, but isn't going to make your government clearance issues go away.   Even an arrest is going to create major clearance troubles.

Just FYI - I was told by a vice cop that Dupont is a hotbed for police activity.  They set up a lot of bait girls at the Dupont hotels.  I asked why they devoted so much resources and was told that these busts are a great way for vice cops to get overtime pay.  So, I suggest being extra careful with the Dupont incalls.
