After some thinking, I want to file a civil lawsuit to get my money back. There is a signed loan agreement. Do you think it'll work? She has to prove she paid me back each month anyways but she can't. The burden of proof should be on her. What's going to be interesting is the discussion about "allowance", "sugar" LOL? As soon as you tell a lawyer that she had the option to pay with sex you will get laughed out of their office - with a bill for their time. Even if the contract/lease does not include any mention of sex, she will argue that she was allowed to miss payments when she spread her legs.

1. This varies state to state so any online lawyer could be wrong. 2. If it's a written contract you can in fact go after her. I would not mention her paying it off with sex. I would just say she made payments and has paid back 20% of the loan. She then stopped paying you back and has not responded to contact attempts. 3. You have to find her to serve her with a lawsuit or small claims. Small claims in most states do not allow lawyers and will make it cheaper for you so it may be worthwhile going for a smaller win. 4. Collections. Good job, you may actually win the suit. Odds are, if you can manage to serve her, she will not show. You get a default judgement. Here's the thing, how are you going to make her pay? If she's a sex worker she doesn't have a paycheck to garnish. Do you know her bank account? Otherwise you are in trouble. 5. Your info is public once you file. You may also have to explain the nature of your relationship with her. That is really up to the judge if he's going to dig or not care one bit. You may have a public record that you visit prostitutes. Anyone doing a background search on you can uncover this case. Some courts will purge old cases after a few years. Others will not.

As far as I know, she hasn't been charged with prostitution. If I don't say, she doesn't say, no one knows. She won't be dumb enough to admit it.

As you probably realize, winning your case and actually collecting the money are, more or less, not connected. If she works, you could get a garnishment order, but for this amount of money it's going be a decade or so before you recoup it. Did she buy anything tangible with the money? I suppose one of looking at it, it cost me hundreds of K each of my many divorces, it stings for a bit, but eventually fades away in your memory.

Cars make terrible collateral. They diminish in value. Any bank loans against it get paid before you. And she can sell or transfer it, claim a lower price that only covered the debt, and walk away.
You are very unlikely to get anything out of this. I would slam her with bad reviews and let everyone know her name on boards then move on.

Thanks for your assessment. She has a no-review policy (now I know why)...also, if I do post a bad review, it makes me appear as a sore loser. There is no such thing as bad publicity.
