Pennsylvania Supreme Court overturned his conviction & sentence today.  The ruling claimed Cosby's right to due process was violated in his previous criminal trial.  They also decided a retrial wasn't an option & the only remedy was his release from prison.

From everything I have heard about this, and I do agree that it's a travesty that he is going to be released as he is undoubtedly guilty as fuck, but the "fruit of the poisonous tree" doctrine is one of the bedrocks of our justice system and applies to the guilty as well as the innocent and prevents overzealous cops and prosecutors from trampling over the rights of innocent people.

 
I honestly don't know what else the judge could have done. Even the original DA admits that "there WAS a deal" and Kevin Steele had to have known what he was doing was illegal, but since he ran on trying and convicting Cosby he kind of boxed himself in. Hopefully Steele will be shown the door and FIRED from his job, but somehow I doubt that will happen.

you didn't mention that the reason for that was the prosecuting DA had granted him immunity from criminal charges if he would waive his 5th Amendment rights and testify at the civil trial. That resulted in the accuser receiving 3 million as compensations. Perhaps that was considered better redress of harm than locking an old black guy up in jail at the end of his life.

Yeah, you can't grant immunity to testify and then renege. He might not have gotten convicted except due to the admissions under the immunity deal.

The case should have never been tried because of the deal..

 
What surprises me is why this wasn't argued in front of the judge at the pre-trial hearings to dismiss the case, and if it was argued, why wasn't it taken seriously.  

 
I hate when some people are calling that he got off on a technicality. It's not a technicality but more like a constitutional safeguard that was not followed.

IMHO there are three crimes here.  Crime 1) What Cosby did to his victims.  Crime 2) What the DA did to Crosby and his victims.    Crime 3 ) Cosby’’s hypocrisy.  

The man preached “Family Values” to millions and specifically  to the African American community.  His message was positive , of  tacking personal responsibility  for ones success and failures.  A very opposite message than what is being preached today.  

Given that Cosby is in truth a predictor , his credibility is blown sky high.  We all have our vices, but to put ones self up on a pedestal and do what he did?  Unacceptable.

Many people condemn the hypocrisy of saying one thing and doing the opposite. This is actually a strange condemnation.  It's a good thing that bad people endorse good behavior.  The alternative is for bad people to endorse bad behavior.  That's worse.

No one is shedding a tear about the "old WHITE guy" Harvey Weinstein being locked up at (hopefully) the end of his life, why should things be different for Cosby because of his race? The only difference is that guilty or not (Guilty of course) Cosby's rights were trampled on by an overzealous DA and Weinstein was tried, convicted and sentenced by the book. There is no excuse for a DA to do what this one did for what looks like mainly political reasons.

He was a folksy stand up comic before he was an actor.  Most of his comedy routines were about family life.  Then he played a dad in his sitcom, so "preaching" family values, in my opinion, was just another way to strengthen his brand.  A lot of actors are not the same in real life as they are on the screen, and most will do and say things that will be consistent with the parts they play when they are acting.   It just shows he was an adept marketing guy, and I wouldn't hold that against him, so I can only buy into your first and second point.

Seems unlikely given what the DA is on record having said and the very hi probability (though I don't know for a fact) that the victim was aware of the deal to get the testimony in the civil trial they were bringing. (IIRC that started after it was becoming apparent that the criminal case was unlikely to move forward.)

Based on your comments to me the answer appears to be "No, I didn't so was just stating an opinion that really had no real relevance to the post I responded to." In other words, yes, some might have approached the situation as you suggested, but your statement is actually a counterfactual in the case under discussion.

This guy was a sexual predator his whole life, and he used drugs to disarm his targets. How much more despicable can a human be? It seems like he should not get a blanket pardon for his actions or be able to buy his way out of it as he did on the civil side. I don’t see why they shouldn’t be able to nail him based on the testimony of a different group of women he abused. The fact that he said he drugged and abused women shouldn’t give him blanket immunity against all women he abused. I hope they figure out a way to charge him again. I don’t care if he’s white, black, famous or not, he should pay!

The conviction wasn't vacated based on ANY facts at trial being contested. It was vacated ONLY because of a prior deal not to indict in which he admitted to the truth of the basic facts of the case.
