I  was exchanging messages last nite with a lady. This morning she said she got a text from someone asking why she was talking to me at 1:30am. I googled it and found there is software that lets you hack someones phone remotely. How is that legal. Has anyone heard of this?

It is legal to hack someone's cell phone if he/she is not a minor and your dependent?  

Having had some stalking situations myself, I'd love to know if there's a way to prevent this software being installed on MY phone (for the hobby, I use google voice on my real phone).  

Also, is there a way to test one's phone to see if the software is installed?

I am guessing here that it was sympathyforthedevil whose phone was tracked and the tracker, being suspicious, contacted the lady. SFTD: Are you married? Have an SO? Shared Cell Phone account? Are you using your real phone or a hobby phone?  

Can you provide more info?

No it wasnt my phone. It was hers. And she said yhis has happened twice before. Im single with no SO. No hobby phone. Might start with a google phone number though.

If the person is paying for her bill they call see all the call logs real time with some cell phone providers.  When the bill comes in you can see the origination and destination of the calls. It goes on the nearest cellphone tower.  

They can install this package to listen in on conversations:

With a higher level subscription some cellphone providers will give you exact locations on a map where the cellphone is. You can watch in real-time. GPS with location services has to be enabled. You can do powerful things such as restricting the hours of the phone calls and restricting who the person calls, who they can send and receive email and texts from. Anyone that installed that on someone else's phone, especially if you're not in some legal relationship with them, is going to have some legal problems too. I also suspect that remotely installing such software would be a challenge -- not impossible but not something many people will know how to do.

That said, that's tame. The FBI is operating rouge cell towers that allows them and the NSA & DHS to suck up a lot of cell phone traffic. You or I would never know because it will forward on to a real tower so the calls go through but now you have the man in the middle that can play all sorts of mean games. (Though, yes I also agree that it's just part of the national level intelligence toolkit for all governments -- and for the most part those with access are good about just ignoring trivial crap like what we're doing.)

It's like Verizon's HUM plug-in for your car.

You have to download an app that allows the phone to be monitored from another phone or a PC.  I haven't heard of any that can be installed remotely without having the phone, but its possible she goes to the bathroom and leaves her phone on the nightstand or something like that, and he installs it while he's there for a session.
