The issue in question is who (or is it whom?) is doing the paying. Generally it is not considered prostitution if a third party pays all the "talent" involved, and films it. If a person pays one participating party, and that same person is in turn another participating party, then technically it could be considered prostitution.
And just to let you know, in some jurisdictions it is illegal to be engaged in the commercial enterprise of filming a pornographic movie, regardless of who (or is it whom?) is doing the paying. So, check your local laws before filming!
if you get the appropriate business licenses, maybe a director, and hire another talent to engage in the act, as well as get the appropriate permits and stuff, and have a lawyer draw up talent contracts and such and have the lady sign a release with her real name....you might get away with it...

Government will always write and administer the law to best serve its own interest.
A porn production company with a registered fictitious business name, payroll records and tax filings will naturally get a positive nod because it is paying into the revenue ravenous, bureaucratic fee & tax system.
An entrepreneurial gal with a cam-corder on a tripod at the foot of her bed is most likely not 'paying' enough into the system to garner you or her exemption from the law.
It is totally legal to make your own beer, wine or hard liquor for your own "personal consumption". It is also VERY expensive and onerous to do so, making purchasing it from the large commercial interests at the local store infinitely more logical and cost effective.
With a window box, or a closet with a grow-light you can grow all the marijuana for "personal consumption" you need. . Government doesn’t care if or how often you get laid or buzzed; but they are damned sure gonna’ collect a tax each time you do. If there is no way to effectively tax it you can be damned sure government will deem it illegal.
The government can get anyone at any time for something. The mass and overlap of laws is such that everyone is constantly vulnerable. It is no accident. We claim to be free, bs, the government owns you. You are a source of revenue and a vote to be bought, nothing more.
i think the biggest ( PIMPS ) on the face of the earth is our own goverment...if we dont pay taxes we get thrown in jail, if a hooker doesnt pay her pimp he beats her , we get punished just like a hooker does, by our own goverment

However, that is not to say that they won't arrest you and send you to court to have it adjudicated. As this happens, you will still still spend a night or two in jail, have to get a lawyer, go to court, and then you may just lose.
