The San Diego Vice Unit is currently doing an investigation on the allegation that off duty cops are calling providers then ripping them off after they have sex with them.  Our unit has been successful in identifying males who have used this ruse in the past.  They are all in jail on rape and robbery charges. We are very serious about these investigations and are interested in any information that a provider may have regarding purported police activity involving sex. Why would vice investigate when that is the job of Internal Affairs? Do they suspect that the off duty officers work in Vice and if they do, should they be investigating their own division?

I am curious, I see an envelope next the SanDiegoVice in their post. Does this mean they have VIP status? I am sure they have VIP status in some fashion but you would think they would pick a more subtle TER handle.

289(g) Any person who commits an act of sexual penetration when the act is accomplished against the victim's will by threatening to use the authority of a public official to incarcerate, arrest, or deport the victim or another, and the victim has a reasonable belief that the perpetrator is a public official, shall be punished by imprisonment in the state prison for a period of three, six, or eight
years.
  As used in this subdivision, "public official" means a person
employed by a governmental agency who has the authority, as part of that position, to incarcerate, arrest, or deport another.  The perpetrator does not actually have to be a public official.

My Comments On The Law Enforcement Poster~~

Whether or not he is "Legit" or not... An initial report to the DA or Internal Affairs regarding rape/assault by persons reporting to be LE is probably the way to go.  It would probably be shuffled back to the correct unit.

Women that date via the internet, whether it be paid escort advertising or Adult Friend Finders, whatever... you shouldn't be soliciting for sex ANYWAY.  So, if you're dating on the up and up, there's NO NEED to report to VICE.  

If you're "selling your time", CLEAN  UP YOUR ACT!!!

In My OPINION, Criminals prey on VICTIMS, and positioning yourself as a NON-Victim by, first off, being a legitimate person in your dealings, no drugs, no illicit activity, and you'll be off on the right foot should you find yourself in the most terrible misfortune of running into a robber/rapist.

If you are forced to have sex that is RAPE, Call the rape crisis center closest to you and go to the hospital if you are going to report. Tell the hospital staff you want ONLY internal affairs if you want to go that route.

EVIDENCE is KEY.  Remember you are going to be torn apart in court, psychologically, it won't be an easy task if you decide to go forward with reporting and prosecuting a case of this nature.  Imagine a jury of your peers knowing that you date tons of hot guys every month!!

( I followed the case of a Law Enforcement patrol cop that had stopped a car and arrested the male half of the couple for methamphetamine.  After a second car had taken that part away for processing the female half of the couple was there with the patrol cop and, according to her, there was a baggie with residue in her purse.  He told her, she could either perform fellatio or go to jail.

She, 19, performed fellatio.  Then went home, told her mom.  She went to the hospital, reported, went immediately to the station where the cop was working from.  The patrol car that he had been driving was impounded, his semen was discovered in the back.  He resigned the same day.

He maintained that the sexual encounter was consensual and maintained that during the criminal trial.

A jury found him INNOCENT. )

In any case, there's no law against posting an ad in the escort advertisements for dating. There are NO laws against exchanging gifts on a date! Date smart! Know who you are with!

There are laws against selling your time as an escort without the corresponding license, and then getting intimate with your clients.  There are laws against making a deal to exchange money for sexual favors/touching.

Don't ever act from the position of desperation, Criminals, like the animals they are, sense fear.

Last, but not least, always, TRUST YOUR GUT.

wouldn't the ladies appreciate a post like this? Also, it could be the violent crimes unit investigating this. They are sworn to 'serve and protect', afterall.

The generalization that was made is not -- could never -- be true:  "They are all in jail on rape and robbery charges"  
Ladies, I would not proceed....unless you want to admit yopu are a prostitute.  I find it hard to believe that a whole group of 12 jurors could find ANY cop guilty of having consentual sex for money and then not paying.  And then ending up in jail.  Think about it.  If it was consentual until you found out you weren't getting paid for it, it's not rape, it's still just sex but both parties aren't leaving happy.

Did you see the difference in Penal Code 289.  If you rape pursuant to sub section a you get 8 years.  If you rape and say your a cop raping, you get 3 to 6 years.  Lesson, if raping, say your a cop.

Vice investigates because I'll bet the people doing this are not really cops - they just say they're cops to intimidate certain providers.

Are some of you paranoid or what? From many of the statements that I have read on this thread, I am having trouble believing that many of the posters are very educated. I would imagine that if one cares to enjoy this hobby, he or she would be smart enough to educate themselves in regards to the law. What would you rather have? A bad guy in jail or a provider getting ripped off or possibly worse? The worst part is I even had to ask that question. Sad!

I understand your concerns that this may not be legitimate. I assure you it is. This was originally assigned to I.A. but reassigned to me in Vice because I have 5 years I.A. experience. Based on the feedback I have recieved thus far it appears this person(s) is not a cop but an imposter. Either way we WILL conduct an investigation if we are provided enough info. Remember...be safe!

The rape would be prosecuted for the base charge and years penalized, then, if under the "color of authority" the section 289(g) would be an ADDITIONAL whatever years penalty~~assuming JUSTICE was served.

It's called stacking charges.
