Where was FEMA's quality control? They actually downplayed the formaldehyde risks.

I bought two of the FEMA surplus trailers for my summer getaway in the boondocks. I was not aware of the class action suit. One would have assumed that FEMA would have warned everyone.

We can't blame this on the Chinese, although our government allowed their bad drywall to be delivered to our shores. Yep. Competent FEDS.

as defined in the underlying lawsuit and you can always opt out of a class action anyway.

      You can sue each seller in the chain up to the manufacturer if you have personal injury and maybe even if you have suffered only economic loss given that the defect posed a risk of personal injury. And if you bought from FEMA you can still sue for breach of contract without that annoying Federal Tort Claims Act getting in the way.

The trailers are only used 5 or 6 times a year, so I have not been damaged.

I do not know how anyone else views you, and I will not attempt to speak for everyone else on the board, which you often do, regarding who you deem to be trolls, but by you dragging up someone's posts from one board to another, you appear, to me, to be quite petty and small in character. I'm just trying to give you a little perspective on how you may be being seen by others; at least one other, if you care at all.

There is no formaldehyde odor that I can detect. It does have a slight odor, but more like fresh paint.  

During the Clinton administration, FEMA was turned into a competent agency that actually did what it was supposed to do. This freaked the conservatives out pretty bad, especially since they like to say that gov't can't do anything right. They got really freaked out about it when they saw that X-Files movie, Fight the Future. I guess I can't blame them. Martin Landau is a pretty good actor. In comes Mister "I can run a horse show", and the rest is history.

Trailers have ALWAYS had formaldehyde issues based on what they are made of. It's inherent and has been that way for over 30 years.

      True, formaldehyde emissions have long been a problem with manufactured homes. And that is why we now have federal standards that limit the amount of emissions permitted,  displace contrary state standard, and even require warning labels in the homes in some situations.

      The question for the original poster is whether the amount of emissions in his trailer exceed those standards. If so he absolutely can sue whoever sold him the trailers whether it is FEMA or if he bought from a distributor or manufacturer.

      It is really no different than if you bought any other product with a defect, or a house with excessive radon levels for that matter. Does not matter whether he was ignorant of the risk of formaldehyde emisions - he is entitled to sue for his damages.

If I would have known you were a 4th generation trailer dweller I would have asked you.

Maybe I would have found out sooner and researched more, but I am not living in them. They are for vacation and short retreats. I found them and bought them at a good price.

There is no entitlement here. I worked for everything my entire life.
