Regardless of whether it's right or wrong, seeing mugshots on TV does give me pause! My wife and I watched the news together and discussed it a little. Needless to say my side of the conversation was very carefully considered before opening my mouth.

Is it really a gross misdemeanor? Seems to me that would have to be at least a 2nd offense or some other aggravating circumstance.

"Public Place" is a problem on the first offense -

"Whoever, while acting as a patron, intentionally does any of the following while in a public place is guilty of a gross misdemeanor ..."

"General" is a second offense Within Two Years -

"Whoever violates the provisions of this subdivision within two years of a previous prostitution conviction for violating this section or section 609.322 is guilty of a gross misdemeanor."
