I agree that LE suspects that this person is engaged in illegal activity.
He needs representation to possibly find out what evidence they have connecting him to the provider and protect his rights to be free of any unreasonable searches.
Any legal advice will be good to have. a friend of mine in Denver has been harassed by LE multiple times.
First here is the background, so he is single and dates a lot of women. He was dating this girl who apparently ended up being an escort. During the time she was being booked I guess she said bunch of stuff against him and then they find that they were in a relationship. Now this guy owns his own store, makes his own money, much like all of us has a mortgage to pay, a car payment and the rest.. your typical working joe!.
So LE keeps going to his store and asking all kind of questions from him. Him not knowing or being involved with anything answered them a few times without a lawyer. He said the truth.. yes they were dating at one time.. blah.. blah.. the LE didn't want to let it go.. so they do a search warrant and rip through his store, home, car, everything and find nothing other than a few emails back and forth between the two of them..some emails did have sexual content in it.. some emails was her telling him what she did and him telling her not to do it.. that stuff..
clearly he had nothing to do with it, but somehow LE is out to get him.. so the question is, are there any laws to sue LE or to take them to court to make them stop? if so what would that law be called!. He is devastated, store business is down, he is stressed and all. This has been going on for months now.
This sounds like one of those cases where some cop has a bug up his ass for your pal for reasons we can only guess at.
The expenditure of police resources for what could only end up as a minor misdeameanor is puzzling. Obviously they don't need his testimony to bag the gal, she's already spilled the beans, it would seem.
There's more to this than meets the eye and a well connected lawyer could get to the bottom of it and make it stop with a phone call or two.
It could be a bit pricey but considering the damage to his business, well worth it the investment.
I agree he needs legal representation. Small towns can be bad. Even a false rumor can put you out of business. He definately needs said lawyer to get to the bottom of this. skb
All you have said is that LE continues to investigate him and does not take his word at face value. Apparently the lady gave info about him sufficient to support a search warrant - just bc it came up empty does not mean they have to stop.
LE needs probable cause to prosecute, arrest, or to obtain a search warrant - not to investigate.
Come back to us when LE either commits a tort against the guy or violates his constitutional rights - until then don't waaste a peeny going to an attorney.
The OP states that LE came back with a search warrant.
If LE was able to get a judge to sign off on a search warrant, I would be willing to bet that there is more to the story than you are letting on. My guess would be that, rightly or wrongly, they suspect he is the woman's pimp.
I disagree with your opinion that this guy doesn't need a lawyer, but for defensive purposes, not to file any type of suit against LE. That would be a complete waste of time and money, if he could even find an attorney willing to do so.
I agree that LE suspects that this person is engaged in illegal activity.
He needs representation to possibly find out what evidence they have connecting him to the provider and protect his rights to be free of any unreasonable searches.
