Most city ordinances can use public nuisance laws to shut down businesses that are repeatedly cited for vioations like this.  The City of Phoenix recently succeeded in shutting down all of our private swing clubs using a similar strategy.  First they labeled them adult entertainment establishments (which they weren't,) then they labeled the private rooms hourly hotel rooms (which they weren't,) and those two moves gave them the ability to take the owners to court, and eventually they won.

City of Scottsdale is trying to do the same thing with the topless club that Jenna Jameson just bought (she lives here.)

About two years ago the USC Pres and AD stopped the use of the name cocks on caps, appearal and novelties licensed by the school. It has not stopped the private businesses from using it on different items
