I have the same question, except for hobbiests. I have a clean record, not even so much a speeding ticket. So, say I'm meeting my first provider and get caught, what can I expect? How long in a jail cell, what kind of fine, etc.

State laws provide a maximum fine and/or period of incarceration.  That is easy enough to ascertain now that state laws are available online.  (Start with www.findlaw.com)

However, a convicted defendant is unlikely to receive the maximum unless (s)he has a criminal record that justifies it.  The actual punishment varies depending on the attitude and resources of the local prosecutor's office and the court.

The only way to find out what punishment is currently being imposed is to talk to prosecutors and defense attorneys in the county who handle the types of cases in question.  That is not something the average person could do.  If a newspaper reporter wrote an article about LE busts, (s)he might talk to prosecutors and defense attorneys and disclose the typical punishment in the newspaper article.

Florida law regarding prostitution is found in Chapter 796 of the Florida Statutes.  A first offense is classified as a second degree misdemeanor.

If you have no prior criminal record you may be able to get a pre trial diversion or pre trial intervention to prevent a conviction.  Unless you have a lengthy criminal history you will not score state prison and will likely receive little or no time in the county jail.  But that will always vary based upon your location and the particulars of your case.

I'm really sorry for what you went through. It sucks!

I could not find anything that supports your claim that being convicted of what we call hobbying makes you a sex offender in Florida, UNLESS the provider was under the age of 18.

http://www.hcso.tampa.fl.us/Sexual_Predator_Offender/2004GuidelinesFiNALREV-05102005.pdf (pp. 18-19 of document, which are pp. 6-7 under the topic Sexual Offenders Status Qualifiers and Requirements).

Take care,
LCA

If you are convicted of  agreeing to a "perverse act" -oral sex- in many states you will be a sex offender.
No one is even bothering to get these overturned.
It is a travesty of justice that consenting adults are being persecuted this way.

Solicitation is a second degree misdemeanor punishable by a maximum term in jail of 60 days and/or 6 months probation.  Second offense is punishable by 1 year in jail and/or 1 year probation and third conviction is a felony.

That being said, if it's a first offense and you have no prior criminal record-a pretrial diversion program with an AIDS awareness course and community service hours.  If successfully completed, your case is dismissed with no finding of guilt.

If your lawyer isn't as good as I am, 6 months probation and usually no jail time on a first offense.  Bond is usually 250-500 dollars.

I live in Texas but practiced and and licensed in Florida.  Have a fun and safe trip and my best advice is to not violate the law.
