If we set up a new practice of hobbyist paying after the act and providers only taking money after the act, would it not be safer from an LE perspective. Since most LE folks won't have sex, having sex may be a good way to prove that both are not LE. Once that is proven money can be exchanged. Only from a legal point of view does this make sense.

Of course if a hobbyist or provider is forced to work for LE then its a different issue

At first glance, I like this idea, but in reality its a bad idea. I think if you do your homework your safe for the most part.

Look at it from the girls perspective. We have all see reviews of girls that were absolute rip-offs. I promise you there are many more guys out that would use this to rip-off girls.  And the girls don't have a review system to point out the rip-offs(as for as I know).

Like I said, do your homework, play by the rules, and most impotently have fun.

"From a legal point of view" it doesn't make any difference.  The law forbids exchanging sex for money.  The order in which the exchange occurs doesn't matter.

I understand...i was just checking if paying after is a good idea as LE will not have sex. If we have not yet exchanged money and I get caught, it can always be said that it was not prostitution. On the other hand once we have sex one can be gauranteed that no LE is involved...unless the girl is working with LE

I agree with you...some girls afraid of not being paid later will not like the idea.

BTW the best providers in my experience are the ones who never ask for money at the beginning and don't even glance at the evelope I leave behind

Your question expressly asked whether this mattered from a legal standpoint.  Whether paying before or after will increase the odds of an arrest is a matter of police practices, not of law.

By asking how you can minimize the risk of arrest, you are seeking advice on how to get away with commiting a crime.  Lawyers are forbidden to give such advice.  Even if I knew the answer I could not share it with you.

I have no such reservations about telling you how to minimize the possibility of arrest.

First for providers:  Screen, screen, screen.

Get phone numbers, addresses, work number and most of all: references.

This may mean that you will lose out on some business, but consider the consequences of just one arrest.  Many, if not most providers I've seen screen with this intensity and I appreciate that they do so as it makes me feel safer this way.

Consider:  Cops don't screen.  What are they afraid of?

Also, never see anyone who is talking about specific sex acts for money over the phone or in email.  Your site should clearly spell out that anyone who does so will be dropped like the proverbial hot potato.

For hobbyists:  research, research, research.

Stick to well reviewed providers and don't be put off if they want all the screening infomation mentioned above.

Stay away from massage parlors and stick with independents over agencies as these two institutions are now drawing the bulk of LE activity.  Also stay away from un-moderated sites such as Craig's List.

If a provider starts discussing what kind of sex acts you want to perform, just hang up.

For both:  discretion at all times.  Don't waltz into a hotel lobby wearing a halter top and a miniskirt.  Dont be making calls to her within earshot of others in the lobby, etc.

No disrespect intended to you Sidone.  I enjoy your legal point of view and your dedication to the principles of the legal profession, but I felt that there is just too much talk on this board of finding ways to beat the legal system while the point should be to avoid it all together.

As another lawyer once told me concerning business law matters:  "If you have to be in court, then you've already lost."

Numerous times these discussions come up on various boards.  The bottom line is, who really wants a lawyer to argue their case for them?

I've had gents ask to screen on-site, "I'll bring you..."  I try to explain to them that face to face is much too late to ensure any security.

...over the years and I have never once felt even remotely threatened by the possibility of a sting.
I manage to maintain this peace of mind by calling on only well reviewed or otherwise verifiable providers and agencies.
The idea of paying afterwards, legal implications aside, would simply not float with most providers as they trust us a whole lot less than we trust them.

That is untrue.  Many providers lament to be shorted even by regulars so i do not see anything wrong if they check the envelope.

...but it was on repeat visits and the girl trusted me already. On a first meeting, I have let my hands wander to her ass, breasts, or even pussy during a greeting hug, and have held her hand against my "package" just to show her I was not LE.
