This forum is full of topics about the disclamers and the conclusion is almost always that nothing like that can stop an arrest. With the new End-Demand clause, where the sanctions are about as steep as the rebuilding of a tooth, plus incarceration, maybe avoiding being convicted could be useful in and of itself. If the court has no proof of the actual deal being made between the provider and client beyond "Oh, we KNOW what they were up to!", how much penalty can the impose?

A real lawyer might be a help here.

Below is what I mean by that. Note (b) in particular.

"SECTION 25. Said chapter 272 is hereby further amended by striking out section 53A, as so appearing, and inserting in place thereof the following section:-

Section 53A. (a)Whoever engages, agrees to engage or offers to engage in sexual conduct with another person in return for a fee, shall be punished by imprisonment in the house of correction for not more than 1 year or by a fine of not more than $500, or by both such imprisonment and fine, whether such sexual conduct occurs or not.

(b) Whoever pays, agrees to pay or offers to pay another person to engage in sexual conduct, or to agree to engage in sexual conduct with another person, shall be punished by imprisonment in the house of correction for not more than 2 and one-half years or by a fine of not less than $1,000 and not more than $5,000, or by both such imprisonment and fine, whether such sexual conduct occurs or not."

This is like jailing the drinkers during prohibition and easing the penalty on the smuggles, producers and rum runners. kind of an upside down approach and we do not have the jail space to inflict the time but the fine is quite punitive and many will opt to not pay it. Any idea what it cost to keep a John in prison? It well not eliminate the male sex drive and will prove to be unsustainable.

Can you imagine the jailhouse conversation,, "I murdered a cop, I robed a a bank, I stole a car,  Me? I got fucked."
In short, this is an unworkable solution to what is at its root, natural behavior. Men have been gifting gals from the dawn of time till tomorrow for a chance to sexually occupy their bodies, if only for a brief moment. Birds do it, fleas do it, even me and you do it.... a sad attempt by idiots to make the nut house break out free.

I would suggest partitioning the state and letting the people who are in favor have a small corner where they can masturbate away the day and giving the rest of the state to the rest of us who can legalize the situation and eliminate any bars to sex for pay.
