Would a hobbyist and a provider be engaging in illegal activities if they were just kissing? My personal opinion is that kissing is not illegal sex. Anyone have thoughts on how LE would view it?

yeah that is pretty impossible.
although "Sex" is defined by each state differently. Usually if any of the genitals are touch,licked etc etc then that can be "sex" (as mentioned before sometimes breast/nipples are included too)
