This I know from reading here and some other blogs, have been lucky enough to avoid first hand experience so far. If you do a search on the legal cases against TER (previous ownership) and BIGDOGGIE.NET there is some pretty detailed info on how they pursued hobbyists, providers and web sites.
They can, literally, fuck you and then arrest you if they want.
I like to think that common sense and a sort of investment/return calculation comes into play. LE is measured based on busts. They do not want to spend 10,000 hours and $100,000 on a sting that only nets one, anonymous, John in Morton Grove, so unless they are after an agency, a web site, or a big shot, the nature of the sting is going to be pretty basic, a single ad, a picture, a phone number, designed to appeal to as many as possible, not a detailed web site with lots of detail, a big track record, a niche market focus, a premium price... you get it.
Having said that, they might turn someone that they catch and then use her/him for a while to get you. And he/she might already have all that detailed info and track record built up before getting busted. So while a track record and web site are probably safe(r), there is no guarantee. Bottom line - they can get each and every one of us if they really want to spend the time and money. The only safe option is to not break the law.
So you have two options to be fairly, but never completely safe.
Stick with well, and recently, reviewed providers. Or develop your own screening approach, and hope you do not end up on the phone with a smart and very convincing member of LE. Option 1 is a lot safer, but most end up doing option 2 as well, but only after a good while, fair amount of experience and all that.
That is the gospel according to Zig. Others, please tell me where and if I have this wrong, cause I want to learn.
