As luck will have I "lost" my wallet yesterday while traveling here, and now my bank is sending cards home (az).  Luckily I have a backup card at home where my assistant can use.  But no way to get cash, so hoping you might help a stranded, wayward traveller in your great city find someone who takes credit cards?

I took them in the past through my agency, but it was a total hassle for both the girl and the client back then. It was before you could get the tiny machines that electronically rang you up...think Amex big bulky machine that you had to swipe lol.  

Now, if the provider does not have you sign a contract saying all sales are final and cannot be reversed, they are too easy to try and get a provider to fk you and dispute the charge. Sooooo, in essence if you wallet was stolen, do you have your ID?

Interesting comment about the legality of a signed contract for an illegal transaction. The "sale" itself is illegal so how does a contract stand up in court? Let's say the hosehead disputes the transaction by not stating that his wallet was stolen but that she picked his pocket when he wasn't looking and copied down his information without his permission. Or even simpler, lost his CC and someone picked it up and used it without his permission. So you go into court with that signed contract and get your ass thrown in jail for prostitution. Just how enforceable is a signed contract for an illegal transaction? Food for thought...

P.S. If I could have foreseen the future about being in this hobby, I would have gone to law school instead, lol.

It's wise to be weary of clients who refuse to pay cash...unless they're an extremely established gent with many references.
There are the scum bag scam artists who will do charge-backs.
Happens all the time with agencies, and many independent ladies too.  

It happened to me once, for almost 2k. no way, not ever again.  
Banks, credit card companies and paypal will all usually rule in the favor of the "buyer" too, regardless of proof, circumstance or anything.

These types of disputes wouldn't make it into court.  They would all be handled by the bank that issued the merchant account and be based on the card associations rules (Visa / MC).  The bank would decide whether to honor the chargeback and pay the consumer their money back, or not honor the chargeback, and let the merchant keep their money.

A lot will depend on the policy of the bank.  No domestic bank will provide a merchant account to an escort service.  That leaves one of two choices - choice one is to lie to the bank about what the account is for.  That is very risky - if the bank finds out, not only will they honor the chargeback, but they will also cancel the account, put them on the "match" list (keeping them from getting another domestic merchant account for 7 years) and likely hold any money for a long time to protect themselves from more chargebacks.    

The alternative is to look at off shore banks. There are off shore banks that will provide high risk merchant accounts - they expect a high level of chargebacks, and charge the merchants extremely high prices to help protect themselves from this situation.  They know what the merchant account is for, however, so if the merchant has good documentation, the merchant can win a chargeback dispute.

In either case, the card associations and issuing bank will tend to side with the consumer over the merchant - they never want to do anything that makes a consumer want to use their credit card less.  And the consumer has at least a couple years to dispute a charge.  They could decide a year and a half later that they were unhappy, decide they didn't get what they paid for, and file a dispute.  

It is very risky for any of the ladies here to accept credit cards.  
 

I highly doubt that escorts accepting payments by CC are using offshore high-cost merchant accounts. I'm sure the majority use domestic banks and something similar to massage therapist or physical therapist as the type of business.

What you're saying is that any type of contract an escort would demand a client sign would be useless as the case would never make it to court. I don't think she'd want to appear in court in such a dispute anyway so they're taking a big risk accepting CC payments. I'm sure they mitigate the risk by demanding personal information from the client such that they could out him if he charged back the transaction after the fact.

All around, using a CC for payment of prostitution seems like a very stupid thing to do. The electronic trail the hobbyist creates cannot be hidden so it's a big risk for the hobbyist if an SO checks the statements. It's a big risk for the provider who has to worry whether he'll charge it back and then it becomes an even bigger risk for the hobbyist who's given his personal information to guarantee he won't charge it back. My technical term for this whole process is YUCK. Not in a million years would I do such a transaction.

They have zero tolerance for adult services using their payment processing system. Paypal is always on the hairy edge of freezing even legitimate business accounts so anything with large transaction amounts and no verifiable material product being delivered is likely flagged immediately as suspicious.

I agree completely, this is NOT a good way of doing business in this hobby.

Yeah, exactly.  There is just tons of risk all over the place for all parties involved.  This is just not a good industry for credit card use.

If you look in the Yellow Pages for New Orleans, you will find HUNDREDS of legal escort referral services, who are and always have been allowed to take money for a referral fee. The providers that work "with" them, not "for them" are on a contract basis and given a 1099. It is on them to not lie and cheat on their taxes, but the agency has them down as a contract employee for their records.  

You are signing a contract through an agency that is registered with the Treasury Dept. and one that also pays taxes on all credit card transactions, NOT with the provider you just paid to fk. I really would not know how an Indy would go about doing this other than to create a faux corporation and have you sign saying this is only a referral fee.  

You are correct that in an illegal transaction (say a drug deal lol) not much would be done, but does a married man really want to take a hooker to court? She would have his real name, where he works, and everything she needed to blast him all over google. He would be an idiot.

Sounds like you are pulling wool over eyes.  You lost your wallet, but have access to your credit card.  The card can be replaced within 24 hours.  You can go to any bank and get a cash advance on you credit card.  Even ATM takes them.
