Ok ladies I have a friend that got a bad check from a guy.. she has not yet deposited it and it does not have her name on it .. to to field was left blank.. any suggestions on what she should do .. and beware of this guy email me for his info

the envelope was on the dresser.. and the lady didnt open it until she got to the car .. like so many of us are guilty of.. anyway .. i just wanted advice not criticism

Why would she accept a check?  Well anyways....Put "cash" in the part where the name is suppose to be and deposit it into your account at the bank where your tellers know you well.

If it does not go thru all you can do is contact the guy and let him know about it....Maybe he thought he had enough money in his acct...an honest mistake...If he has no intention of making good then just consider it a lesson learned and NEVER accept a check again.

PS...I think everyone should pay up front...not talk about it because it is a mood blaster....put it in your purse once it is laid on the nightstand or where ever....excuse yourself to the bathroom to freshen up for not longer then a couple minutes...count it...if a descrepency then let him know when he is undressed :).  A cop will never undress.   A cop will wait for you to talk about money while he is fully clothed though.  Yes, I am speaking from experience....was about three years ago!!  LOL

How does she know it was a bad check without depositing it?  The name was probably left blank because he didn't know the real name to write it to.  I often will write a check, leaving the name blank for OTHER services (maid, cook, etc) where the person may want, for one reason or another, to let someone else deposit it in their account, or if they don't have an account they can get someone else to cash it for them.  He may actually have had good intentions.  For the record,,I never pay a provider by check :)

Here is the way to handle the situation.  Fill in the check with 'Cash' in the 'to' blank.  Go to the local branch of the bank, and ask the teller to confirm that there is sufficient balance available to clear the check.  They will usually tell you that much.   If it is a bad account number, you will know right then.  If there is no balance, you can hold the check for another day and try again.  Otherwise, if balance is available, either cash it or deposit it.  If you cash it, you will likely need to provide ID, D/L#, thumbprint, etc, but you will leave with cash in hand.  Depositing the check will avoid the personal ID, but your account number will be indicated on the check.  Also, there is still a small chance that other items will clear before yours does, and the check will be returned.

First of all do not put Cash on the pay to line, put your name there. New bank procedures frown on "Cash'. Then write your  name and account number on the back and deposit it.

If it bounces you can give it to a collection agency, give it to the police or go to small claims court. A business license is better for you if you go to court or use the fuzz.

The check needs his correct name on it or you will have a hard time proving it was him.

If one legally investigated his assets and financial condition and they were in the black it would be easy to collect.

Johhny Wad is a pro at this and guarantees collection legally but it would not make sense to engage anyone if it is a small amount. Might give out some advice over a beer or two.

p.s. Do not fear it was for a possibly illegal service as
'fu@@ing' was not written on the memo area of the check. You need to have a reason of why he paid you.

Back in the 1970s the mayor of Cincinatti saw a provider across the river in Kentucky and paid by check.  The info ultimately came out and embarressed/ended his political career.

The amazing part of the story is that the mayor's name was Jerry Springer!  Yes, the very same one!

Off topic, but I always thought he was re-elected AFTER that incident...  Also, the State of Ohio loves that guy...  most people wanted him to run for Senate (which he declined)....

Most banks have a number you can call to verify funds.
Once you have verified the funds are actualy in the account
and the check itself isnt bogus, it might be best to have
some one else cash it for her directly at a branch of the bank.
