My point remains that the rest of us can't have as much fun laughing at the stupidity of the OP on the Newbie board. Here we can tell the OP EXACTLY how fucking stupid his idea is.
Cliff's Notes summary:
1) Pornography involves three parties:
one who pays the other two to engage in sex acts.
2) Prostitution involves two parties, one of whom pays the other so the latter will engage in sex acts.
THUS, whether it is the payor or the payee doing the videoing of the sex acts, it is prostitution, not the creation of pornography, which may be protected.

1) Porn could involve just two people: an actress masturbating while a director records it on film. That's two people = porn.
2) Prostitution may involve three (or more) parties. Many guys & gals on this board have done a three way. That's three people = prostitution.
open a string of Porn Memento shops. Customers come in, pay a video fee, pick an actress, and go at it. Pay some guy minimum wage to collect fees and wear a T-shirt that says 'Director'. Hmmmm, what would Uncle Antonin say?
Anyway, shouldn't this be on the Legal Corner board?
It is said 'There are no dumb questions" on the Newbie Board, There are however a LOT of stupid answers given here, including OP's that answer questions that weren't even asked.
We are required to be "nice" on this board, and I would hate to break that rule, I do however reserve the right to comment a bit further on this stupid thread once it lands on the proper board where calling out stupid people for being stupid is allowed.
oops, did I just call the OP Stupid???
do I go directly to jail without passing Go?
And do porn actors have to sign notarized statements that they do not enjoy their work?

& most is shot in California. Claiming innocence of one crime by pleading guilty to another is totally rediculous. (Or explain it to us!)
the answer remains the same. It's surely not worth it to rent a studio in a legal jurisdiction, get the lcenses, pay for the STD testing, get all the required state & federal paperwork, model releases (real names), insurance... hire the business office who must maintain the records (proofof age & consent) forever. Oh, yes, no one is going to pay to watch a chubby guy banging a cute co-ed.
I would imagine that pornography will involve the "director" and "producer" to keep all paper records of the artists, such as age, etc. Basically, the difference isn't just the act but also the legit business document proofs
