I am new to this hobby. I am on work visa over here and not a US citizen. I would like to know what will be the case if I get caught by LE ? Will I have same rights like a citizen (4th/5th amendment)?  Also any one knows, what will the sentence for solicitation in state of Virginia ? Will they put in jail if caught for first time ? Will it effect my work or immigration status later on ?

You should consult an attorney.

If you look at some posts on this board you will see that ladies caught escorting are sent back home. He needs to be careful. He might want to chill out until he gets his us citizenship if he is afraid of being arrested. I know in some busts (street walker stuff) in Maryland they sent the guys back home out of the US.

A local Law office where you are located and ask a lawyer. You will get accurate info for your area and know where you stand.

I dont know what the penalties will be here in the US with the local LE.  The end result will be your deportation and refusal of re-entry (under any type of visa).

Plus do a Google search using these terms: misdemeanor solicitation "green card" CIMT

Here are a couple of relevant responses:

Per the Adjudicator's Field Manual used at USCIS, you are eligible for the exception to the effect of a Crime Involving Moral Turpitude (CIMT) conviction if (1) you have only committed one CIMT and (2) if that crime is a petty offense, defined here as having a maximum possible penalty of no more than one year of imprisonment, and your sentence (if you were convicted) does not exceed six months.

Link to appropriate section of the Adjudicator's Field Manual:

But Leagle Beagle's response probably gave you all the information that you needed anyway.

be very careful. ice sees solicitation of a working girl as a crime of moral turpitude. That means if you ever try to get a green card at any point, you'll have major issues with a solicitating charge on your record. and remember IEC is federal, they dont give a damn about your state's laws.
