A provider I know just got arrested for prostitution. She is thinking about leaving town and never coming back to DC. Seems ill advised to me, but she is getting pressured from her "manager" to leave. What are the potential consequences? If she stays, shows up for her court date and gets probation(Her first offense) will she be allowed to leave town or will she have to stay in DC. She tested positive for stimulants, claims its diet pills. Is she likely to be forced to get regular testing? Any advise
Make sure that she does not miss her court date. Also she needs to make sure that she does not default on the bond payment.
First a first time prostitution arrest is a minor charge wich in most cases just means a fine unless there are other issues. Second they do not test you for drugs when you get arrested for this so how did she test positive for anything?

I agree with "pattaya729" they dont drug test girl who are arrested. Sounds like the girl is lying to you and they found stimulants on her. In any case she should get a public defender if she cant afford a lawyer. She shouldnt just leave the area...she needs to show up for court or she'll have a warrant for her arrest and her little problem becomes much larger.

EVERY...EVERY person arrested in DC is drug tested for all drugs except marijuana and alcohol. I don't t care if its prostitution, drugs, simple assualt, or whatever....every person arrested in DC on a criminal charge is asked to submit a drug test in lockup prior to their arraignment that day.

Are you saying that what is enforced vs the max penalties in the DC code tend to be on the lenient side for first offenses? Do you know how often they incarcerate? Learned that DC has Prostitution “Diversion” Programs. Seems on the surface to be a good option but requires sticking around the area to complete the program. It appears to me that the charges are dropped by the prosecutor after completion of program or maybe I should say the charges could be dropped and usually are. Anyone know how difficult it is to get into this program?

As a pretrial arrestee...ALL defendants drug test in lockup. 99% of positives will have to drug test through pretrial. PRETRIAL condition will include drug testing and a stay away from the location.
DC SUPRIOR COURT is extremely ( triple underline) liberal.
Second DC drug lab will NOT recognize a diet pill as a prescription drug to account for a drug positive test. Regardless of thatvshe will have to test weekly with Pretrial. She can choose any day M-F to test. DC is built on treatment over punishment...so even if she is positive, she'd have to be beligerently positive and refuse treatment beforePretrial recommends her removal....and even then, my experience says MOST judges in DC will not step her back.

I heard from a friend that here was an indy who got arrested yesterday in downtown, but she is in a far bigger trouble, as she is not a US citizen and was not even supposed to be here in the first place. Hope we are not talking about the same provider. That one may be better off leaving the country anyway.

If by "not supposed to be here" you mean she is out of status / an illegal alien, I believe she would be deported if they find out her status. But even if not, any chances she had to get her papers are now gone. Good luck explaining to an immigration officer at your interview why you were arrested for prostitution. Good mora; character is one of the requirements and in the US we still do not consider engagement in the hobby as morally acceptable.

Thanks did not realize this. Totally explains why this leech does not want her dealing with the system. If she gives him up as a deal to reduce or dismiss her charges he faces real time or at least a serious blight on his record. Best thing for him is to get her the hell out of town. Effing sucks

Perhaps the legal system in a way is encouraging the need for " Individual managers". If everything was completely in open like for example Amsterdam, the need for protection would be diminished. Booking agencies would fill the void.
