It means customers info will no longer be kept confidential, and upon request DC will share customer info with law enforcement agencies. The "Retention of Customer Data" section is quite interesting. Basically, DC is saying that they might loose some customer info due to burdensome nature and cost associated in retaining customer info. With that said, I would cancel my account (I don't have one. Thank God) and hope that DC would eventually loose/purge my info as stated in the "Retention of Customer Data" section

It's just their policy on how they deal with subpoenas that are issued to them. Nothing stands out as particularly worrisome for me.

For example, they are saying that they require formal service of process before they will comply with any subpoena. A lot of larger companies, like some banks, etc. get so many subpoenas that they actually set up processes whereby you can just fax them a subpoena, etc. - to make the process easier. My reading is that DC is not doing this. So DC is saying you have to actually jump through all the bureaucratic hoops the law sets out if you want to subpoena them. This is probably a good thing for everyone involved (except maybe the person issuing the subpoena).

Obviously a company like DC could potentially receive a lot of subpoenas - and not just in criminal investigations, either. My guess is that they would probably get more subpoenas in civil cases like divorce, etc. In law firms I've been with, we always sent out WAY more subpoenas in domestic cases than we ever did in criminal ones

If their servers are US based, they have to share data with LE for various reasons. Easiest for LE is to say they suspect someone being at terrorist or supporting one and as such they get all of the data very quickly. TER servers are overseas so they have a bit more protection against aggressive LE requests but I am sure that too can be managed by LE if they wanted to.
