Are we talking about the same Kelsy? What has she "copied" that is yours? Before talking to your lawyer, I would do her the small courtesy of sending her a note. She had the web site done by someone else, so she will not be aware that her site may have transgressed, if in fact it has. Be gentle. She is, as the reviews say of her, both intelligent, gentle and very considerate.

since it's my old site that she ripped off.  A client of mine came across her site on Saturday and during our appointment told me that she had shamelessly  copied it word for word.  When I went home I checked it out and sure enough about 80% of the wording on her site was directly lifted from my old site. I sent the link to my web designer thinking he would think it was funny but he wasn't laughing.  I did send Kelsy an email and she did change parts but there are still a few things on there that were his "babies",  mainly the stuff on her "Kelsy Way" page.  My next email to her pointed out the fact that she still had a lot of my old stuff on there at which point she got nasty with me.  That really pissed me off because I was doing her a favor by warning her how pissed off my web guy was.  Her response to me was at "least I did my site myself and didn't have to pay someone to do it" (sure if ripping off the wording is doing it yourself, you go girl!).  And " if he was such a good client of yours why's he cruising Eros" (ummm, I don't own my clients).  And to tell me that copying my site didn't make her look bad because she was booked for a month (in this economy, I think not).

Anyway, to make a long story short she angered me and I replied back in a very nasty way and I shouldn't have.  But the fact remains that some key stuff on her site didn't come from her head, like she would have you believe.  I'm sure my web guy is just pissed and blowing off steam but it would be better to be safe than sorry, wouldn't it?

That is some Irish temper Kara.  Like the state motto of New hampshire says, "Don't tread on me".  Hope the snow hasn't been too bad and that enjoyed the New York chianti.
