It is stealing.. it is a federal crime of theft.. and it is up to the copyright holder..

If you let him get away with it once, and then he does it again.. and again.. then someone is losing out and then it is also difficult to claim copyright infringement later.

Ask your photographer if he minds someone stealing or displaying his work...

It is nice that you are trying to be nice to him this one time.. but I bet it isnt his first time.. only the first time with your picture. He probably thinks he is getting away with it cause a couple of very nice ladies didnt seem to mind.

Dog, I also do photography, I did my pictures with self timer, I have nice camera, good lighting and basic backdrop. If any of girl want to have some nice photos I can do it, I am not a pro, but I am fast learner and very creative *wink*

You have nice photos. I wonder if there's a "promise" of a disk with oics like yours- then the poor girl is out the cash she paid for them. Bummer.

yeah..it's sad indeed.  O well...at least he did not tell on his ad that my photo is taken by him.

As a professional photographer myself.... here is what you do.

1. Contact the photographer.. give him the link.

2. Get him to send a email to Backpage, telling them he is the copyright holder. And asking them to remove his work, as the poster did not have permission. to steal his work.

3.Have the photographer go to:  http://labnol.blogspot.com/2007/09/dmca-notice-of-copyright-infringement.html
and copy the DCMA take down notice so that he can send it if needed.

This is assuming that the photographer holds the copyright. In the U.S. the person taking the picture (the photographer) holds the copyright unless he gives it in WRITING or sells it to the model or someone else.

When I take pictures of any provider.. GG or TG, I give them a document allowing them to use or reprint the images as they need to. Including the right to send a DCMA notice if needed.

Ah...in most cases, i am a nice person, can be too nice probably from time to time.

I see it as a minor fraud.  I let him go this time.  Besides, he only post one pic and it's also pretty small.

But definitely your input is worth it, this things might be crucial in other cases
