If the law gives you shit for banging an illegal, just say Lawyer and don't answer any more questions. Then call your lawyer and have them talk to the police or ICE.
Simple, you are dating someone. You did not discuss her citizenship. She has not asked you to marry her so she can get a green card. You are allowed to help out a girlfriend from time to time. They will need a warrant to get to any communication where you discussed sex and compensation if you have that in text. Your lawyer will deal with all of this. Best $500 you will spend.
In the end, they don't care. They are not after older guys getting laid. It's not a crime. It's more and more common for huge age gaps in relationships. As long as she's over 18 and consenting you are good.
Just got back from a 7-week trip outside the US. And I was watching various news reports (multiple sources) on immigrant issues with great interest.
The US Immigration folks at US airports can require you to unlock your phone prior to readmission to the country. My concern was not for any SB's. It was if I had a potential problem from the text messages and photos that are on my phone. How difficult would it be to prove that 19-year-old bar girl I banged in Bangkok was really over 18? And no, I did not get a pic of her ID. But once I realized the risk, I did get pics of IDs from any girl that was under 25.
Even then, the day before I flew home, I uploaded all my pics to a cloud app and deleted them off my phone. (On an iPhone that is a two-step process.). Next, I deleted the cloud app from my phone as well. My rationale was that even if some Immigration officer demanded my phone, he/she would likely only look at apps on my phone (pics, messaging, email, social media, etc.) and since there was no cloud app, they would not/could not ask to see my data from other sources or devices.
Fortunately, I have had Global Entry for 2 years. Going through Immigration at LAX was literally just a 30-foot walk through a lane with facial recognition cams while an officer waved at me, smiled and said: "Welcome back, Herb."
As to local SB's without "status," it's not really something I worry about for myself, other than the risk she may be "disappeared" and I won't know what or why it happened. Of course, I rarely go BCD at an SB's home. And as far as I know, none of my SB's are even slightly politically active - though I wish they would at least be politically aware!
