She is not totally unaware because she conspired with the girl who answers the phone.  She isn't unaware.  What would she do if no one slipped an envelope in her purse afterwards??

Would the following scenario constitute breaking the law?  Picture this:  The hobbiest calls to set up an appointment; the girl taking the call is not the provider. He is given the information regarding location, and the gift amount he may want to consider giving the provider for her time, (she is still working on how to word this).  He is instructed to place this "gift" inside the providers' purse,(AFTER services rendered), while she is in the restroom, and totally "unaware" that he has done so. In this case, she is not knowingly accepting $ for sex.  In addition, during the entire encounter with the provider, there is no mention of exchanging $ for sex.  Can the provider be arrested in such a case??

At the risk of sounding like some sort of snotty lawyer(which I am not), this sounds like some sort of bar exam question. You can invent whatever fact pattern you like, let's start with the premise that COPS LIE!!!! OK!!! Any questions?  You are not going to get the pattern favorable to you. I don't care how many people you put between yourself and the provider, it don't mean squat.  If the cops want you, they want you.  All of this is based on common sense; the individual that feels his/her way through life has the advantage.  That person can smell a cop a mile away.  It is, after all, about how it all feels.  I can't tell you anything more.  It's just that way.  A street wise person will know who it is they are communicating with.  It either feels right or it doesn't.  Sorry for all the gobbledegook but that's the way it is.  If you want more specifics, ask away, BUT remember the police report is NEVER going to be written in your favor; it will be written with a view towards obtaining a conviction.  How do you beat it? Once again, thanks for the response Levendi; and you're absolutely correct.  It's apparent that if LE wants you, they'll figure a way.  Like most of us feel, there are way too many real criminals out there....why not spend time and resources going after the murderers and rapists!  Anyhow, she is planning on starting her business soon; I will pass along what I have learned and wish her luck.  Thanks again to all.

The fact that there was no explicit communication between the provider and the customer is pretty irrelevant.  The customer was told that after he was done, he should leave the "gift."  The provider, undoubtedly, expected that the "gift" would be left and provided the services in question on that expectation.  Masking the communications doesn't change the fact that communications happened and a transaction took place.
