It's considered rude and shouting to post in all caps and many of the mods will not allow it...

As far as your problem, I don't know that there is much you can do other than to spread the word on the boards and in your ads. No doubt your former agency owns your photos and that cell number and can do whatever they want with them.  Hopefully they will abandon the deception as word continues to spread that the gal they are advertising is not you.

Best of luck to you!

The agency owns the photos only if they are the ones who took the photos. The photographers own the copyrights to photos they take.

If the agency hired a photographer to take the pictures and paid for them the agency more than likely owns the copyrights to photographs. Obviously it's all subject to whatever written agreement, if any, exists between the agency and the photographer.  This is one of the reasons that a lot of agencies use old porn star photos with blatant disregard for repercussions. The PS's seldom own the rights to the photos and whatever magazine they appeared in years ago is generally not around anymore or not likely to come forward.

If the agreement was to pay for the rights to the pictures after the photo session, then the agency does own the copyright. But just the fact of paying a photographer for a photo session does not give the one paying nor the model the copyrights.

And the agencies that think they can use old photos of anyone, pornstar or not, without subjecting themselves to a lawsuit is wrong. The photographer (or other owner of the copyright) can sue any agency for publishing the pics. Presenting them on a public website is considered "published" in the eyes of the law.

The original agreement and the paperwork is what matters when it comes to copyrights...FWIW, the two agencies I use in Boston both own the photos that they use.  The primary reason is so that the girls won't be able to use them if they leave and also to protect the agency and the lady from the photographer selling the pictutes to anyone else.

As far as the agencies using old porn star pictures, I did not mean to imply that it was legal, just that they can get away with it. Of course, you never know who is going to see the pictures and, if the copyright holder can be contacted then obviously the offending party can be prosecuted.

I had a problem once a couple of years ago with an agency advertising my pics. I simply called up each and every damn site they were advertised on, told them that they were using my pics that I owned without permission and that I was not affiliated with them in any way and you'd be surprised how quickly they came down.

no the agency i used to work with hired another girl and is passing her off as me...even though im still working under the same alias..so people think its me when it isnt because shes pretending to be me...

I know guys will think this sounds dumb, but the Agency doesn't want the legal scrutiny, so just a threat is all it takes.
