Anyone know EXACTLY why "T.E.R." is NOW allowed to operate openly in the U.S.?

As someone just said, they made some changes that have already been discussed and should be easy to find here. No "deal" was necessary. Do some research.

well, if I were the PARANOID sort, I could agree with your line of thinking.  

I think a more likely scenario is that the owners of TER sold it to people who are less risk averse and think that TER can be a great money maker like it was before the FOSTA melt down.

The law came down there came after BP and others.  TER administration got scared and rather than take charge just block USA users which stop any one to lazzy or cheep to set up a VPN. Other sights did stay in the USA many ran on servers in eroupe and have no problems.  When came down if want to police under max there would jail every sight owner.

Making TER unavailable to U.S. users was a voluntary direct response to passage of the Stop Enabling Sex Traffickers Act.  Sort of a CYA response fueled by the political atmosphere at that moment in time.  TER is again accessible to users in the U.S., but not because they've been "allowed" to do so.  At the bottom of this page are two tabs which I believe are new to this site:  Human Trafficking Policy and Law Enforcement.  Under those two tabs is a huge amount of legalize, which I'm sure many lawyers hashed over for countless hours, that in essence causes TER to voluntarily feel confident to make their site available again in the U.S.

Not sure if your post is referring to MY query, but, trust me, it's not like"T.E.R." is operating on some OBSCURE outskirts of the "dark web" that only a certain, privileged FEW know about.

Scroll all the way to the bottom of any page and you will see “Human Trafficking Policy” and “Law Enforcement” policy.  The human trafficking policy applies to TER employees and its agents and independent contractors and is zero tolerance.  TER will report anybody they think is involved with that.  The Law Enforcement policy is much more liberal in its compliance with lawful requests for your personal information.  This is meant by their lawyers to show at least an attempt at good faith compliance with FOSTA SESTA and to create a defense to them.  Whether they ran this by the US Attorneys office first is anyone’s guess and I’m not about to try and find out.

First off, what ever gave you the idea that TER was "allowed" back??? There isn't a stitch of evidence that TER cut some sort of deal, that the law/s changed or anything else to suggest that there was some kind of accord that allowed TER to resume operations as usual.

Costa Rica in particular has VERY strong anti-pimp and anti-trafficking laws. By not persecuting/prosecuting consenting adults it gives them a lot more resources to use in combatting real trafficking of both adults and minors.

It doesn't have to be "beyond reproach", only "beyond reach."  There are provisions of FOSTA/SESTA that apply to offshore entities that are OWNED by Americans, so the ownership must not be in the names of Americans.  I have over 30 years experience in owning offshore businesses.  I think I know how they did it, but I'm certainly not going to publish it.

They went offline because of SESTA/FOSTA. The US government has prosecuted zero online orgs or the owners of them. (Except backpage, of course, which was before SESTA/FOSTA). The law is flimsy and there are already states that are attempting to repeal it.  

Firstly, the obsession is completely on your end. My first post was a simple question as to why you found it necessary to capitalize nearly every other word in your posts. The distraction this causes from the content of the message itself should be self-evident, and would be if you possessed even a scintilla of self-awareness. I'm completely on the same page re having some fun at his expense. Where I differ is simply the methodology. If you read my posts carefully, I'm actually not engaged in polite debate. To do so would assume he has an argument or point that's worthy of debate, which he certainly does not. Abuse is counter-productive.  It shuts up people with interesting ideas and encourages those with diarrhea of the mouth to froth on.  You just have to look at some of these "insult" threads that go on and on.

I've been posting on various boards since the early days of SF Redbook (some crazy flame wars there!) and unfortunately a kumbayah attitude usually has no effect on users like LLL. Neither does a straight insult-for-insult strategy, as that just keeps them going. What does often have a positive effect, IME, is shining a light on how foolish and ridiculous they are . . . i.e., embarrassment. The effectiveness of this strategy lies in its simplicity and in the fact that there really is no counter-strategy. Consider the possible outcomes: 1) The poster continues to spew spittle-flecked drivel and, with every additional post, more people see how ridiculous they are and tune them out until they're nearly universally ignored. 2) The poster shuts up. 3) The poster decides to post something constructive, in which case (at least for me), those posts should be treated accordingly. Not sure how far back in the thread you read but I didn't post a syllable until the LLL style of using ALL CAPS became too much to ignore. I pointed out how distracting it was and it wasn't until he started attacking me that it was "Game On." So, if you construe what I've posted as abuse, may I respectfully suggest that's a misdiagnosis. What it is, if I've done it correctly, is ridicule . . . and ridicule with a purpose. The current default m.o. for LE is to show up unnanounced and grab all the servers, computers, phones, other records, etc. Then they run everything through their forensics unit to scrape every last bit of data. And, of course, they take plenty of photos so they can make a big splash in the media as to how they took down a "dreaded trafficking" operation. How a client's information ends up being used will obviously depend on a lot of variables. But the key and most important point is that ALL of those variables will be out of his control. The only opportunity he ever had to maintain control was to not give his info in the first place.

What I believe is that L.E.'s MAIN concern is not whether a bunch of ADULTS pays another bunch of ADULTS for their "time," but rather if said adults are engaging with MINORS.

why they decided to come back. I feel an explanations should be give to the community. There are ladies that have come back and A LOT that are not coming back because they think some type of deal  was made for them to come back.  I know a lot you that responded decided to stay with TER even when they were not available in the states.  However, Lolo does have some valid concerns that represent how many feel about TER coming back.  Since SESTA/FOSTA there have been a lot of changes with a lot of sites and agencies going down. Nothing I feel has gotten better, so why come back now?

They went offshore to try to establish immunity and took steps to comply with or create a defense to stupid SESTA/FOSTA.   This involves proper entity formation and official registration in the host country hopefully with the advice of competent legal counsel.  That's about all anybody needs to know about it.  The intricacies of such practice are easily found on the internet and much of it is just boilerplate anyway.

The intricacies of complete anonymity while maintaining functionality are NOT.  Your post seems lifted from one of the hack sites that "sell" offshore corporations "set up by an attorney" as a package deal for less than $10,000.  A lot of Americans who buy these end up in prison IN THE U.S. for violation of various U.S. laws.  I've been using offshore entities for 30 years and its a constantly evolving market.  Using a "packager" is legal suicide.    I DO agree your simplistic post is all that needs to be said here.

The OP requested a simple answer.    No it is not lifted from anywhere.   Yes of course there are “intricacies” to it but again most of those are boilerplate that you plug into your paper with your specific plans/needs. Of course I agree that having  a crappy lawyer charging less than $10 grand  or worse, a paralegal document prep service set it all up for you is not the best plan and will likely not protect you from official scrutiny if you are doing something legally dicey which sounds like what you are talking about by your comment about jail time.    You better have a damn good accountant as well.

The two key words in my post are anonymity and functionality.  Most foreign jurisdictions that allow anonymous ownership of corporate shares will not allow the anonymously-owned entity(ies) to have a bank account in that same jurisdiction unless they voluntarily give up their ownership info.  (This is a recent development in the last 10-15 years as many countries try to address drug money-laundering and make it unattractive in their county.)  So while there are many places where you can get an anonymous corporation, you almost always have to combine several jurisdictions to get both anonymity AND functionality by way of a foreign bank account, so it necessarily means combining different jurisdictions and layers of foreign entities in different jurisdictions with bank accounts that are "offshore" from the domiciles of the various  entities, so that there is no paper trail back to the individuals who are shareholders in the original holding company.  Getting it right the first time can run upwards of $80-100K, plus travel expenses, so its important not to fuck it up and have to start over.
