I have been asked by a provider that I haven't seen in years to make a website for her.  She is UTR right now, but would like to have a website for clients to see, just like many other providers have...

I have a legal question...If I create a website for her, nothing on the website will be explicitly stated of course, the usual words like INCALL, OUTCALL, DONATIONS, etc...I will create the website and help maintain it when it is down, etc.., but other than that I will have no affiliation with her, I will receive no money, etc, since I am doing this as a favor...


If she were ever to be busted, can I be charged with being a pimp or contributing in some way?  All I am making is a website that advertises for ESCORT, nothing explicitly stated...????

Nope.
You are are no more respoonsible for what she does with her website than Craig's List, phone books or newspapers are for ads.  You simply are creating a website, what she uses it for is not your responsibility, and you should hold no culpability should she use it for anything that might be illegal. :)

can you be charged -- most definitiely yes. You can be charged with anything, by anyone, for anything, at any time. That is our wonderful legal system. Whether you can be convicted is a different question, but there is no doubt LE uses the exhorbitant cost of defending oneself against unfair accusations as a tool.

LE casts their net wide and charge people with all sorts of things to see what sticks.  Sometimes their rudimentary knowledge of the law even results in them arresting people for tthings that aren't even illegal (this per my lawyer who is one of the top defense lawyers in LA).  

But the truly unfair part of our system is that they've got the taxpayer funding their witch hunts, whereas the high cost of defense for an individual can be so prohibitive that they start coping to all sorts of things they shouldn't.  

This hasn't been discussed in a long time on TER, but LE definitely uses this tactic against providers and their clients.  I had the misfortune of experiencing this first hand with a ROB agency and you wouldn't believe how much it cost to defend myself against the people who came to my house to rob me.  As I found out, you can accuse people of anything without proof.  And in my case the ROBs (both of whom had criminal records) were never even required to testify.  They blew-off the court on three occasions and the judge didn't even issue a bench warrant for them.  Meanwhile, I still had to continue fighting the charges brought by the prosecutor at the rate of $400 per hour.  If you want to lose your faith in our system, just go through what I experienced.

I have heard of one situation where a web master was contacted by the State Atty's office that was prosecuting a lady on P charges.

Personally, she should find someone that is comfortable with this and well-versed and not bother you.

She sees you as convenient and safe is my guess.

She would be best served by having the web servers hosting the site out of the country.

There are plenty of escort web designers with servers and support in Canada or out of this country and this geographical barrier adds a layer of legal protection and insulation that will better serve her.

just make sure she is over 18 and that you keep the photos decent so that she isn't charged with anything relating to minors viewing her site

I suppose you can always be charged - prosecutors can be extremely creative. Whether you are found guilty or not is another matter. If you had a strange rash on your johnson would you ask this well meaning audience or a qualified physician? Same goes here, IMHO... If you are worried ask a qualified lawyer...

Since there will be no explicit offer on the web site, I would think you're O.K. and not breaking any laws.  Just make sure the hosting account is in her name.

there is nothing illegal about escorting, and esp if her site was clean.  Suggest you post on TER's legal board -- often a few kind attys there willing to lend an ear and give guidance.  Though they're too kind and we should pay them appropriately....

If pandering and prostitution are felonies where you are, a prosecutor with nothing better to do could probably make a conspiracy charge against you stick.  And there's always criminal facilitation.  I wouldn't worry about it too much inasmuch as prosecutors probably would call it a day if they prosecuted the person actually using the site to set up dates.  Of course, they could spend their time prosecuting murderers and rapists if they wanted to spend our tax dollars wisely.
