She tried to unzip his gorilla outfit, but the zipper was stuck, so he ripped a hole in the crotch and started banging this girl on the couch in the frat house. My friend walks in drunk to a gorilla fucking a naked girl. I think the girl sobered up and realized she was getting donkeys kong lol. Embarrassed she ran out naked out of the frat house. To this day, probably the funniest true story I've heard.

Two drunk people having sex doesn't amount to rape given neither are in a position to make a rational decision -- both are impaired and both made the conscious decision to drink (though probably not to get so drunk).
That the girl ran out naked may suggest she had not really sobered up but that perhaps she was afraid of the third party that (to her probably) suddenly appeared on the scene. I don't think her running suggests anything much about the nature of the sex act but doing so naked certainly suggests something about impair mental capacity.
If alcohol deprives both parties of the legal capacity for rational thought, then the man cannot be held responsible either.

No. But even if she didn't, for it to be rape the man has to have the ability to form consent, too. More than that, he has to have mens rea, or "guilty mind." He has to know she isn't consenting.
You could have taken depositions from other people at the frat house saying any reasonable person would know she was too drunk to have sex, and that he wasn't. But that's not in evidence. What is in evidence is that what she was a willing participant at some point, trying to pull his zipper down. We don't know that it became obvious she was no longer a willing participant, except when that she ran out of the house. That doesn't necessarily mean she realized she was being raped, though that's one possible explanation.
The obvious solution is to bring back in loco parentis on college campuses, give girls a curfew, have them sign in and out in order to leave their residences, and make all parties have chaperones.

Back to the OP story. We have zero knowledge of consent or lack of consent. If there was real consent, it would be funny. But, running out naked does not show an ability for good judgement.
Fortunately, we live in a time where non-consensual sex (rape) is not being covered up, made excuses for or tolerated near as much as it used to be. Still has a long way to go.

Even in a crime as heinous as murder the state of mind of the perpetrator is considered. Thus we have first and second degree murder as well as voluntary and involuntary manslaughter (often called third and fourth degree murder.)
As reckless as drunken driving is, death cause by such is typically charged out as involuntary manslaughter
This is how screwy we are on the subject of rape. What is rape? Forcible intercourse (or "sexual contact," or whatever) against someone's will. Just like murder, it requires intent. Drunkenness is normally not enough to convince people you couldn't form intent, in cases of murder and rape alike.
How did you surmise the victim was raped? By the fact that she was drunk? No, because both were drunk. The fact that she was the woman? More likely. But why does the woman lose her ability to form consent due to drunkenness and not the man? See where I'm going with this?
Who is taking advantage of whom, if both are drunk? You can't know, unless there is other evidence to go by. Evidence which may or may not have been adduced in this case, though that's highly debatable.
It sounds like rape given the lady sounded to drunk to give consent. Not funny in the least. The guy should be locked up, and I do mean to scold.

This will probably not go down in the annals of laugh out loud sex stories but I once hosted a lady many years ago in Dallas who as she approached my hotel door I was standing outside nearby kind of hanging over the railing looking into the courtyard. I had watched her walk in and take the elevator to my floor. I knew this was my date. She approached my door hesitantly as I think my presence made her feel uncomfortable. She knocked at the door and I turned around and said to her "some guys have all the luck" and then proceeded to put my room key in the door and let her in. Inside she immediately slugged me and then fell into a tight embrace and we kissed deeply and proceeded to have one of my first 10/10 experiences.

From what I know it was a mutual thing, this wasn't my story. Not condoning rape, nor did think it sounded like some messed up story. Apologies that people thought this was something other than a funny situation, guess I got the wrong crowd, I'll see myself out then.
