I would think no because there was no penetration (vaginal, oral and/or anal). Exception maybe: did you verbally agree to have actual sex and then during the session refrained for some reason? Just PLANNING it may have been illegal.... but if upfront terms were "make out and grope only" from the beginning it should be ok. but sorry I don't have an accurate legal answer, just another related question:

Many states have differing interpretations on what constitutes sexual activity and I'm sure some states' laws would (or could be interpreted as) falling into the make out and grope catagory.

You might want to post this on the Legal Corner Board and see what the mavens there think, but I want to stress that your best way of avoiding coming face to face with LE is to make sure you always see a well reviewed provider and place a premium on discretion at all time.

As far as engaging in a serious grope/make out session with the right provider, that could be a lot of fun.  It would sure take me back to my high school/college days, that's for sure.

I'm only confining myself to a completed prostitution offense, not solicitation or attempt, since solicitation or attempt is more about the attempt than what actually happened. The definition of sexual contact varies from state to state, and even some cases from city to city. For example, North Carolina defines it only as vaginal intercourse. Fellatio, cunnilingus, and anal intercourse are not considered sexual intercourse within the law prohibiting prostitution. On the other hand, California defines prostitution as any lewd act in exchange for consideration. Lewd act is contact with the buttocks, genitals, or the female breasts. So in California, a person paying to grope a woman's breasts is prostitution. So, as always, go consult a local lawyer on how to break and not to break the law.

Either you're busted or not.  If you're busted somehow, although I can't see how unless she's a LE decoy (there's no way she would kiss or grope if she is for reasons that have nothing to do with the law and everything to do with working in a male dominated workforce) does it really matter if you "broke the law?"
