it is unlawful(LOL)to change a rate on any accepted(verbal or written)contract. Any changes made to an accepted contract become subject to a 'change order'. Cha-ching!!!!!!

I book an appointment a few days in advance. Web site and most recent ad says $300. Day of appointment I check her web site again and her rate now says $400. Confused, I put $400 in envelope. Afterwards I mentioned how much I had put in envelope and asked if it was the right amount. She said yes. I was slightly annoyed.

Yes, I could of canceled or addressed the situation with her before the appointment but frankly I really wanted to see her and while paying $100 more was annoying, it wouldn't have stopped me from seeing her.

But I think she should have told me she was changing rates when I booked with her or after she had done so. Or, the appointment should have been at the rate I booked at.

Ladies and gents, any thoughts?

Many ladies have touring rates, is my understanding.  Could that have been the issue?

In any case, its a good thing to verify the rate ahead of time... for BOTH of you. That way there is no misunderstanding.

She should have but you put the $400 in the envelope so it was her call.  Providers are in it for the money and you offered the $400. If you would have put $300 in it and asked if it was OK she should have said yes.  If she would have corrected the $300 to $400, I would have been pissed.  I fully understand what you mean about the 100 not making a big difference, it's that you feel taken over it.  My advice let it go, if she is worth it go back, if you can't let it go move on.

You said you would have seen her regardless of the rate. So, why are make a big deal of it now.
If it were me, I would have mentioned it to her before we meet. You only have yourself to blame for your annoyance.

I was asking a question. Wondering how others would have handled it.

Despite that minor annoyance, I had a great time and have seen her again.

If I was making a big deal about it I would have posted on my regional board and mentioned the provider's name.  I didn't.  I realize I could have backed out or could have pressed her about the donation prior to the appointment but I didn't want to ruin the mood.

My guess is this is something others have/will face at some point and it's not a topic that gets discussed everyday.  


Thats what this site is for. Providers ripping off people need to be noted in reviews. Often, I put in reviews, good or bad, the bad ones often dont get posted. Those are the ones I want to see. No show girls, rate game girls, and other rip offs need to be noted. So we dont get ripped off or tricked. Ussually, once you get there you will pay.

Then you saw her and hopefully had a great time and paid $400. What's the beef? Or as Wendy would say "Where's The Beef".

Hey, I hope you gave her the beef and did it good. Girls have a right to change their rates and do not need a disclaimer to do so. You also did the right thing by putting 4 Benjamins in the envelope JUST IN CASE.

you should have addressed the issue with her then. That was your responsibility. In the $ for play biz,sudden rate hikes happen all the time. WTF----if you were so compelled to see her & presumably had a good time, why the crying over spilt' milk ( or jzz ?-----;).

I had set up an appointment with a provider who had an incall. Hours before the appointment she said she could not host at her incall and we would have to meet at a cheap motel. In addition I would have to pay an extra $50 to cover the cost of the cheap motel. I respectfully cancelled.

but obviously she didn't.  That was the wrong way to handle it.  When I changed my rates everyone that was already booked got the old rate and I made sure to let them know ahead of time so there was no confusion.  Anyone who booked after that date got the new rate it's as simple as that.  Sounds as if she just didn't have good business sense because she got your extra $100 but I seriously doubt she made you a returning regular.  Seems to me she loses in the long run.  Regulars are so much more profitable.

Clients should be informed of last-minute rate changes.

And there's an aspect of this some providers might not consider.

I suspect a lot of hobbyists are like myself in that we are very conscientious about making sure the right amount is in the envelope. We count the money OCD just to make sure.

Because appointments for me are a logistical nightmare; I probably won't know about a same-day rate change unless the provider pro-actively calls me. (That's why she has my phone number for any last-minute changes!)

So I'd go through with the appointment never the wiser. Likely, she wouldn't count the money until I left. (Really) So I wouldn't know anything was wrong until I checked out her website that night in preparation for sending a thank-you note. (I always send a note even if it is my umpteenth appointment with the same lady.)

And then I'd be freakin' horrified I had shorted her. Horrified. I mean, hell, that's worse than leaving skidmarks.

PROFESSIONALS don't let that happen to hobbyists. They keep in touch and let them know about anything materially important. Such as, oh, little stuff like the envelope.

LMAO! Did you really expect her to say "no, please pay the old rate" when you asked her that question?! I would have paid the rate that was on her site when I booked the appointment. I'm willing to bet she wouldn't have said a word.

and if the lady expected me to pay a rate that was not in forcde when I mdade the appointment I would decline to keep the appt.

The rate that prevailed at the time I scheduled the appointment should be honored.

What I'm saying, your Honor, is as follows:

I completely understand that NO agreement specifying anything illegal has any LEGAL validity. Except, maybe, as the basis for a criminal conspiracy charge.

But let's leave that aside for the moment, and approach this from the perspective of any other agreement for sale of services. Pretend instead of providing me sex (fantasy, of course), Ms. X is designing a website for one of my businesses.

Pretend that Ms. X and I have agreed that she will design a website containing certain specific features in exchange for my flat-rate payment of $3,000; and that she will commence work on Tuesday.

Pretend that Tuesday arrives, and Ms. X declares that she will be happy to start work; but the price has just changed to $3,434,978.

The question is: am I now obligated to pay her $3.4M for a website she agreed to design for $3,000?

I have used an extreme here to make the principle clear -- because the same principle would apply if she had changed the price to $3,001. Or, if I had declared she should be designing TWO websites instead of just the one.

The agreement stands as-is and is NOT subject to unilateral modification. Even in consumer contracts such as credit cards that allow such modifications; notice of a change in terms is required in order to give the borrower an opportunity to pay off the debt rather than be bound by the new terms.

Now, let me take this back to a provider and a hobbyist.

Today I scheduled an appointment with Miss ClassyUpscale on Tuesday at 11:00am. Her advertisement said her price for that appointment is $400. So does her website. Today and tomorrow, her website says $400.

Tuesday morning, she changes her rate to $4,000. Furthermore, she fails to inform me of this change prior to 11:00am.

Am I obligated to go through with that appointment and pay her $4,000?

No.

Our agreement was for $400. I AM obligated to a $400 appointment, but NOT to a $4,000 appointment. The only way I am obligated to a $4,000 is if she gave me notice and I accepted the new terms.

Again, I used an extreme to demonstrate the principle; but the same principle applies if she changed the rate to $401.

Think of it this way, your Honor. What if, that morning, I informed her that she was going to be seeing me for twice the previously agreed-upon time, but for the same price? Would she be obligated to go through with that?

Of course not.

In *practice*, I would likely go through with the appointment if I knew of the change and the absolute dollar value was small. (Say, $100 or less.) But that is because I am a nice guy; and NOT because I am obligated to pay willy-nilly same-day fluctuating rates.

So that is where I stand, but I am subject to having any errors in my reasoning exposed and corrected.

I do not pretend to be an expert in contract law. And the legalistic arguments in this thread are beyond silly. This is so simple. If the lady expects the rate change to apply, she should indicate that. I always check the website on the day of the appointment. If I note the rate change, I will ask. It is quite possible that the rate change includes a service change. If I want the new service, I pay the new rate. What I do NOT want is a lady with an attitude problem over what I put in the envelope. That is guaranteed to be reflected in the quality of service I can expect to receive.

I recently increased my rates.  I put out a general blurb to my regulars (and those whom I'd seen 3 times or more) that the old rate would still apply.  I've held to that promise.  Regulars have return, and many new ones have not complained at all.

I agree with those above that she should have given you the rate that existed when you booked.

A side question......what are you doing talking about $$$ during the meeting?!?!?!?!?!?  That's a no-no.

date was made, is the rate you should pay.  I had a lady up her rates a week after I made the date, with a week to go before the date.  I emailed her, and let her know I should be under the old rates.  At first she said no, the new rates.  I respectfully let her know she now had a one week notice of a cancellation.  She then changed to you just pay what you think is fair, and lets just have some fun.
She was so freaking awesome that nite, I gave her a tip that made up the diff between the old, and new rates.
This doesn't have to be hard.  I feel that once you've committed to seeing her, that her rate AT THAT TIME is the rate for that date.

That just seems fair!

put 400 in the envelop...You should have put 300 in....You asked the question...so of course she is going to say Yes...even though it was wrong...everyone handles there business differently...I personally would have given You the choice of either taking 100 back or adding time...fair is fair...I want to create a win-win situation...so we are always having Fun and Enjoying the Pleasure of each other ;)

where I live rates seem to change constantly. Specials for this and that, so it can be confusing. I usually same something to the lady at the end of the session about the donation in the envelop.

I have to agree that it sounds like the OP mishandled it ... not that it's easy if you're nervous and in an unusual situation.

You don't want to overpay.
You don't want to cheat anybody.
You don't want any misunderstandings.
You don't want to be unfairly blackballed.

I think I'd have started with the lower amount and, if she's the type who checks at the end (or maybe after you've left), asked her to check the envelope for whatever reason ... "I was in a hurry and I want to make sure it's OK before I leave."  If she says there's a problem, work it out right there. "Oh, I didn't know about the new rate." "I didn't think it applied to me because I booked before the new rate. I'm glad I asked! I don't want you thinking badly of me!" [Too mangina?] Whatever, just something simple to smooth things over, and then cough up the difference with an apology and a hug.

If she checks at the beginning, you'll have to judge by her response.  "Excuse me, sweetie, but I think you made a mistake." versus "YOU F'ING SLIMEBAG! WHAT THE F ARE TRYING TO GET AWAY WITH, YOU DIRTY F'ING CHEAP BASTARD!"

In the former case, you can probably smooth things over quickly and get on with other activities. In the latter case, I'd try "?Que? No hablo Ingles."

...as others have said, it is equally your responsibility to confirm the rate PRIOR to meeting. The fault lies with you both, so try not to get only upset with her. ;)

Personally, if I've already scheduled a date for the near future and raise my rates in the meantime, I honor the previous rate AND let the gentleman know the old rate will apply -- even if only for that date. I don't like to pull bad surprises like that, but if there's any confusion on his part, I expect him to speak up about it.

unless of course I was planning to eaise rates then would tell prebookings its going up. They would get the old rate but not grandfathered in like my reg long time clients.(unless of course they were extra yummy...;) )

Are you SURE you were looking at the correct lady initially...  I mean people get confused.  I had a fellow email me the other day saying he wanted 'x, y, and z activity.. like it says on my website'
He was obviously confusing me with someone else he had looked at since no where EVER on my site had I listed those things.  

sometimes men see a special ... it might have said $400/hr - discounted to $300 until Feb 26th... or something like that maybe?  Men sometimes skim..and miss some important detail.

I find it incredible to believe someone just upped the rate with no warning the day before your appointment.   You should have mentioned your confusion and see what she had to say.

I'd think SHE'D be concerned.  How many men go back and check the website fee section over and over?  If a girl relied on a guy reading... I'd think she'd be pressing her luck.

I have had ppl call me and tell me they saw me last week and when they say where I tell them it wasn't me. they then realise its ANOTHER Nicole. Happens all the time.
you could also be confused, but should have addressed the issue with her before you paid her and I am sure if it was the case she would honor the old rate. you did not give her the chance to do so.
