My bet is that the question of aesthetic bias hangs mightily among the culprits, but that is only a supposition based on what I see motivating people's strongest reactions.

Is that if it wasn't pleasurable, people wouldn't do it. Don't forget that courts vary rarely make new law. Laws are passed by legislators and state houses that may have very puritanical majorities. As we start the Thanksgiving holiday, we musn't forget that this country was started in large part by puritanical extremists who escaped England because the English became less rigid in legislating morality and "pleasure". Courts are loathe to step too harshly on laws passed by elected officials who, in theory at least, are acting on behalf of those who elected them. Courts often have to dance around morality issues to strike a balance between what is constitutional and how some of our less enlightened elected officials think we should behave.
Is it still permitted to ask why it is a religious tenet among so many to insist that government "stay out of the bedroom" yet be involved with every other aspect of our lives?
