I "lady" friend of mine, warned me to be careful of "whitelistings" stating that if I had reviewed a lady and she white listed me then that is confirmation of what happened in the review. Thus, making my review not fiction in the eyes of the law.  

I did not really understand where she was going with her thought, but I thanked her for the advice and thought that I would just the knowledgeable people of this board

How is a white list connected to a review connected your handle going to connect to your real info?  Lots of paranoia around here these days.

I was told the same thing by my lawyer.  I am not sure what the laws are in California; yet I suspect that if a court of law wants to use a TER profile against a provider that her white lists will be included in that and could possibly be construed as proof of the appointment.

Ask an attorney who is knowledgeable in criminal law if you really have an issue...but suffice it to say that unless your friendly LE is in the room with YOU when you're meeting your "lady friend"....then there is simply nothing here.  And in that case...STFU and call your attorney!!!!!

That isn't to say that these reviews couldn't be used as another means to get you to babble if you were caught with your "lady friend"...but I'm sure you have watched enough "cop shows" to know...STFU and only request an attorney should your "lady friend" set you up in a sting.

you will have to explain that your reviews are fantasy should a matter ever go to a jury, and all I can say is good luck with that.   But but but, at the same time, the chances of these matters going to a jury are remote, to say the least.  But your words are always there to build a case against you so don't even worry about the whitelist thing -- you will have your hands full with your own words and convincing anyone who needs convincing that you are doing your best Tolkien imitation.  But it should never get to that point for many reasons gone over in the last week all over this board.  

The good Doc and others are right.  While there seems to be heightened LE interest in the comings and goings within the hobby, it is still not like this is the highest of priorities and only in rare cases likely stemming from taxpayer complaints would so much investigative resources be used for what is still considered a low level crime.  

Pimps, yes.  Human Trafficking, absolutely.  Low hanging fruit nuisances who are ruining the hotel stays of regular patrons, kind of a 'don't make me come down there' situation but they will if necessary... But grown ups in a discrete, individualized relationship where money happens to be exchanged for reasons known only to the parties - not so much.    

Yes, there will be jurisdictions that looks for splashy headlines with prostitution busts, but check those headlines - very very rare that it is a one on one situation.  As others have said before, not worth the time, limited resources, no harm/no foul.  

Here's your example to keep in mind: have a high stakes poker game in a hotel lobby, blow smoke from a joint in an officer's face and they have no choice but to bust you.  But other than that they could likely care less.  Same here for the most part.     Just remember, this is very much a 'don't you make me come down there' situation - but yes, they will come if you make them, and then all bets are off as to anything you say or have said.

and each time it does, the take is that in order for that evidence to be entered in court, LE would have to subpoena TER's records which are in the Netherlands, and that isn't going to happen, so we can all relax on that score.

In prosecuting a client, the state must establish that there was specific intent and agreement to engage in contact of a sexual nature with another person in exchange for a fee. In the absence of direct evidence that survives procedural muster, or circumstantial evidence that establishes intent and agreement, the state cannot meet its burden. Unless, of course, they have your confession.

So rather than worry about the, at best, tenuous culpability from whitelists and reviews, exercise the discretion perfectly articulated by Skyfyer and mrfisher. And should you find yourself in the crosshairs, follow the time honored advice from the board – call your attorney and keep your mouth shut

Anyone who posts and reviews here has a track record that could be brought up in court ONCE YOU HAVE BEEN BUSTED. In theory, this track record could potentially be used to bust you, but that is one hell of a massive stretch and it is a bust that would be all but guaranteed to be tossed out of court (no real evidence unless someone, and probably more than one person, is prepared to corroborate that he words are true). So it is something LE would only do in conjunction with some other bust (like you were embezzling funds and using them for hookers, dealing drugs, or just getting caught in a prostitution sting) or if more than on lady you reviewed turns on you.

The odds of your words here being used against you are not zero, but pretty close to zero unless you have already been busted for something. And even then, without some corroboration that the words are anything more than Internet BS, your words are still close to worthless to LE. Because there is an endless amount of BS on the Internet, and we have the freedom under the constitution to spew that BS.

As I have said before, and Scarsdale said even better, LE is not in the business of chasing hard to investigate and prosecute long shots, but rather busting as many people as they can in as efficient and cost effective a manner as possible. Budgets, arrest rates and convictions are how their performance is measured. Do something truly stupid to get busted, then follow that up with flapping your mouth a lot, and you will be in deep shit; avoid LE as much as possible and if you get unlucky and are busted, keep your mouth shut and get a lawyer. Then you will be publicly embarrassed with your picture and the record of your bust online, but that is the end of it.

Sure, there are other possibilities, but they are all really, really unlikely.

I always thought we (the providers and clients) were some how co-writers of great fiction.  He starts with a impossibly made up scenario and we chime in with a "yeah right, that's what really happened lol" and give a "whitelist" as a sort of applause for his imagination and creative efforts.

...yours is a damn good take on this, and I'm a glad you all feel good with mine - I think we may have traveled some of the same roads that now can enable us to help our friends here to gin a new and hopefully less stressful perspective - and I like how you put it as there is a difference between zero and 'almost zero'.

There are other ways this information can be used that has nothing to do with subpoenaing records from the Netherlands.  I am hesitant to get too deeply into it here as I don't want people to panic unnecessarily.  Anyone on the legal board should know what these other ways to use the information are.    

That said, a lot has to happen in order for the trail of breadcrumbs to lead to someone on this board.   Fortunately, in many ways, we have a better chance of winning the pick six

For what it's worth, I fully agree with your second paragraph - brilliant - and much of what is in your first. But please remember that each state has different laws that have different elements and evidentiary requirements, and there are also many related crimes that that one can be charges with even if it is not the P word.  

But I think we all know that this is NOT the singular reason LE wakes up each morning (sometimes tho we need to remind each other as it's easy to get in the grip of all this well meaning and self interested concern).  Generally stings and arrests in this area are like the baby that is left on LE's doorstep.  Something happens to get their attention - that gets them involved.  It is far more reactive than proactive in 99.9% (I am guessing as to the actual number but you know what I mean) of the cities and counties of this great land of ours.   But we all know stuff does happen, hence your second paragraph.

Because otherwise, nobody give's a rat's behind about tracking down a hobbyist using anything remotely complicated.  

Providers, maybe, but rarely.  I need to be careful about things, you guys just need to be savvy enough to keep it out of a divorce court.  And for that purpose, the sort of spying you're talking about is illegal.
