I tried resolving this via email and with phone calls for almost 2 weeks prior to this email. I have copies of all the sent emails to you and GG requesting a screename or handle of the "reviews" held in your "extensive QA process" which we both know really is you reviewing them. You chose to repeatedly ignore my requests to professionally resolve the situation.
Your board APPROACHED ME and asked me to promote and support you, in which I did and have the mass emails and specials I did to promote you.
As well as when the webcam broadcast idea was planned I assumed your large company would have the equipment and facilities to do it. Most providers don't even have their own PC's but you got lucky with me and against my better judgment (also in emails) I allowed you to convince me to purchase a web dig cam (I did not need and had I been not pressured as much would have obtained a couple free ones from my old team at Logitech) for $150 and then to further expect more from me you directed me to purchase CableSpeed connection since my DSL (which I get free here becuase I fix it when it goes down) costing another $275.95 for the modem and $30+ a month for service. I know of at least 8 SP's that began using your board against their initial judgment because your reviews are so explicit that it could actually be evidence in court as the fees paid and description are on the same form, plus unless the SP paid a monthly service fee they do not have access to them to promote themselves. All of my reviews that were submitted - which according to my emails from clients should be a total of 7 or 8 were of clients that joined because of my promoting your site. And this is the treatment you give them and me?
Both David/Debbie and Bear forwarded their responses to you and as I suspected they have the same impression I do about your professional service. Both stated they were not contacted by you when a question arose about their reviews and were concerned why you had not done that which resulted in what we are discussing now. Promoting your board was the least adventageous for me from a marketing perspective. Due to your rating system I would not be able to score above a 7 in performance and the turn-over time that they would be posted was WEEKS. All other boards have been much more fair and quicker turn around, as well as the moderators
have contacted me immediately if a problem or issue arose, and these are the FREE boards...
Bear told me he did in fact use my PC and logged in to TER, I would have thought considering the relationship and demands you were expecting from me to promote you, you would have taken the time and contacted the parties directly before deciding and I quote from GG "David says you has multiple reviews all from the same IP and machine name, so he was going to banish me you from the board, but I talked him out of it", Upon hearing that and after sending numerous emails for 2-3 weeks about the missing reviews I was puzzeled why you would not have just given me a call or responded to my repeat emails. I then told GG that I was furious that you would ban someone at the drop of the hat. If you were the large company with the big security and review QA teams, you could have certainly been more thorough and more professional in your handling of this. My last phone conversation with GG led me to beleive you had even convinced him I was capable of this false representation and I was "lucky" I could still be on the board. LUCKY? I expected you to do your job and post my reviews on a timely manner as well answer questions regarding the validity of your accusations PRIOR to my feeling I finally had to ask my clients that stated they posted in the email. It was not a public spectacle, you left me no other choice.Thursday night in the phone call I just referred
to GG called me back and stated you told him you would call me back that evening and I relayed if you didn't I would be sending the email to clients the next day. I sat by my phone until 3am and no call. I sent 2 more emails to you only to be ignored as well. I know how ugly rumors get started and it is my belief if you confront the accuser and demand the proof from the onset you are made aware of it, then you have witnesses to your attempts to resolve it before it is too late. I just got 2 emails from potential clients stating now all of my reviews are missing from the link GG provided me to put on my website. My site gets about 20,000 hits a day and people do read it. So I went to verify it and now my link returns the error:
"This provider information is no longer available on TER."
So you have this one chance to amend your lack of professionalism and resolve the the situation and that is to post my reviews back on the site and complete the webcam broadcast as promised - so my investment has not been wasted. The alternative is for you to continue conducting business under questionable policies and practices - showing your lack of customer service for both SP's and hobbyists and obvious lack of the "staff' you proclaim to have since you randomly made remarks to ban me before even discussing it with me and find out the facts.
If you continue to act in this manner I will file a suit for damages to cover the monies I am out for the equipment you requested, the free advertising I sent your way and the proof of loss of revenue from your delays in posting my reviews and removing my reviews. I will encourage my clients (the public email list of clients I have amounts to over 300) to not post on your board based on the emails and evidence I can provide and the fact that you would not provide proof of your accusations, as
well as those who joined on payment plans to seek refunds for the service they never recieved. This is not a threat it is the only reasonable way to get you to stand up to your promises and fulfill your obligations, I do not not appreciate businesses that protray professionalism on the surface but in actuality are a one man shop who can't handle all the services they promise to deliver.
By finally acknowledging the issue because I had cc'd clients that may be affected by it and then stating I was unprofessional and implying this was the first you heard of it was a nice try but unbelievable.
You then had the audicty to relay you thought we should part ways when you had already made the decision to cut the relationsip based on the fact that I was being honest trying to FINALLY resolve this after hearing you were considering banning me, made you look like you were grasping at an excuse for not performing your job and not showing concern to resolve the issues in a businesslike manner.
I rarely promote others and only if I believe they fall in to the same category of quality and professionalism that I do, and I would like to think that maybe you have just been overwhelemed with all the new traffic I brought you and are willing to mend fences and return to the business relationship we had up until this arose.
If I don't hear from you by tomorrow morning and my 4 or 5 reviews are not posted back up on the board, I will notify everyone on my emaill lists and other boards as well as attach all relevant documentation and evidence on my website homepage letting others know how you use and treat your clients. All you had to do was make one phone call to me and call Bear but you chose to ignore all prior contacts until you looked bad in front of a few clients it may have concerned, no harm was meant in the email. I was only finally trying to resolve the situation. I invested a good chunk of time, money and effort to promote your business and in return I get this....
I would like to clarify a few misunderstanding that, by reading your email, you seem to have.
1. Gentleman Gym is not an employee of theeroticreview.com (TER). He is an unpaid volunteer that has taken an active role in the Seattle message board. He neither has nor has implied the right to speak on behalf of the management of this site. He spoke to you as a friend. In retribution, you have only forced him into the middle of a situation he has no control over.
2. Your purchase of a web cam was unnecessary because Gentleman Gym, after hearing (and reading in emails) of your financial situation, offered out of his own money to by you one. You refused and elected to purchase one. Most stores have a 30-day return policy. I would suggest you take advantage of that.
3. I am unclear why you felt it necessary to purchase a $275.95 modem when your cable company offers rental of a compatible modem for a much more reasonable monthly charge (Probably around $10). Possibly it is because you wanted to host your own website at your home as we talked about in our last conversation. In any case, what you decide to purchase for your computer needs is outside of our control. It was not demanded of you.
4. There is no “loss of revenue from your delays in posting my [your] reviews and removing my [your] reviews,” because no income was promised. The purpose of TER is to provide information to its members. There is no agreement, implied or otherwise, that states we will create revenue for you. We are not here to increase your income level.
5. If you refer to our guidelines to submitting reviews (http://theeroticreview.com/reviews/submit.html) Item 13 clearly states, “We are not obligated to post any review.” This is an agreement that each member, who submits a review, must agree to before submitting a review. In fear of the legal threats and actions on your part, we elect not to post your reviews or have further dealings with you.
6. We have not “randomly made remarks to ban” you. In fact, your basic (free) member account is in good standing. Only your reviews have been removed.
7. Your emails were not ignored. Sometimes I have other issues to attend to that are higher priority and cannot respond immediately. Please accept my deepest apologies for not responding to you in the timeframe you felt appropriate.
After your letter expressing disdain over how this site is run and the very mean and hurtful comments you have made regarding myself, I have a question for you. Why are you trying so hard to be listed here again? I think the truth is self-evident. Your goal was never to promote TER. Your goal was to use TER to promote yourself. I am sorry that it did not work out for you.
