It is not just a matter of paying back the $130,000. If that were the case, some tabloid television show would have paid that months ago.
There are two other issues:
1. Liquidated damages which could be awarded in the millions in this case for violating the NDA. This is not an employment situation. This...if true...is a matter of consensual sex between two adults. There is zero sexual harassment here.
2. Daniels attorney is really walking a very fine line here. If he is getting paid by an outside source, he could be facing ethical proceedings in front of his bar because he must disclose the source of his fees. There is no expectation of attorney client privilege regarding his fees. There is a ton of case law behind source of attorney fees. They are then subject to subpoena and deposition. If he refuses to disclose money source, then he could face everything from disbarment to criminal proceedings including money laundering and wire fraud.
Bottom line he has big balls...

Stormy, her attorney and their backers are playing a suicidal gambit here. This will continue for years to come because it will never see a court room while Trump is President. After POTUS leaves office whether that is in 2020 or 2024, it will go to court. It will cost these folks a ton of money and most likely this attorney's career. He can argue this in the court of public opinion till hell freezes over. What will ultimately count is what transpires in a Federal Court Room and this guy is way over his head as well as facing a host of ethics charges.
