Chutkan handles the Protective Order

I had been wondering about all sorts of things. E.g., could a judge hold defendant's counsel responsible for their client's actions?

E.g., could Chutkan have said to Lauro and Blanche, "You know the law and you understand what I am saying. Trump can't threaten, intimidate, or "out" potential witnesses or jurors." I don't think she can put that on the lawyers. At best, Lauro and Blanche might say, we can proofread and edit his tweets. We can proofread his rally speeches  but he usually goes off script and we can't control that. When he gives extemporaneous interviews to Fox and OAN, it is totally unscripted and spontaneous and we have zero control." Obviously, Chutkan did not do that.

The order actually says Trump’s counsel has to maintain custody and control of these materials, and that his **** counsel has to inspect any notes Trump takes regarding them to make sure the former president hasn’t copied down personally identifying information.***** Because Trump can't be trusted to obey the law or a court order if left unsupervised.

How to enforce the order? Chutkan might have threatened Trump with incarceration if he blabbed sensitive info but then she would be challenged within a few hours and have to "lock him up!" which I don't think she wants to do. I was wondering about other possibilities (e.g., suturing Trump's lips shut) but nothing seemed workable.

The DoJ asked for a trial start date of Jan 2, 2024. The Defense will probably ask for some time in 2025 or never. I think it will be decided at a hearing on Aug 28. Chutkan might pick a start date in February 2024.

As some observers have commented, Chutkan has put the trial start date in Trump's hands (or mouth). Let's see what he does about it.

He's just not controllable and she knows that. But he will test the boundaries and she will slap him down as you suggest, with a BANG!

The judge isn’t going to engage in that type of tit for tat behavior. Would make for an easy appeal case by Trump’s defense team.

I used large increments (Feb cut back to Jan to Dec to Nov) to explain the idea: "The fact that the defendant is engaged in a political campaign is not going to allow him any greater or lesser latitude than any defendant in a criminal case." "I caution you and your client to take special care in your public statements about this case,” Chutkan told Trump lawyer John Lauro during a hearing. “I will take whatever measures are necessary to safeguard the integrity of these proceedings."

Talking heads are now speculating that Chutkan may end up agreeing with the DoJ's request for a Jan 2, 2024 start date and might even begin jury selection in Dec 2023.

Since the hearing on Friday (it is now Sunday and Trump was campaigning in Iowa on Saturday), Trump has been directing his "free speech" at Fani Willis in GA, calling her a racist, alleging that she had a sexual affair with a gang member, and so on. I.e., Trump is afraid of Chutkan.  Trump is probably just working out with his surrogates and cult members (Don Jr., Eric, MTG, Boebert, McCarthy, Gym Jordan, Comer, ...) who is going to carry on his anti-Chutkan, anti-Smith, anti-Meadows, anti-Pence, anti-witness, anti-jury campaign.

EDIT: When I started a list of surrogates who will be attacking the DC Prosecutors and Courts, I left out Matt Gaetz. On Saturday in Iowa, Gaetz called for violence in DC:

for the DOJ is that if the trial goes forward and Trump is acquitted, it would prove this was all about politics.  Then watch the tidal wave of voters rally to Trump over the actions of a corrupt DOJ.  It would be a smart move for Trump to try to get the trial moved forward, whatever he has to do, including pissing off the judge.  

     
How's THIS for an alternate scenario?     . . . . Let's say Trump loses the trial and is convicted, then Ron DeSantis steps up and promises voters that, if elected, he will pardon Trump on his first day in office.  It will be a Red Tsunami.  The DOJ is in a no-win situation and poised to take down the Dem nominee, which half of Dems already say is not fit to serve. DeSantis for President.  He saved Florida during Covid, now he can save the country from the Liberal craziness.

That was a rhetorical question. Why? Because DeSantis' campaign is dead in the water and probably can't be resurrected. So he won't be pardoning anybody. Not to mention GA, where Presidential pardons don't work.

...a Texas woman to threaten to kill Judge Chutkan.  The woman called the judge's chambers at the Federal Courthouse in D.C. and left this voicemail:
"Hey, you stupid slave n—-r.  You are in our sights, we want to kill you.  If Trump doesn’t get elected in 2024, we are coming to kill you, so tread lightly, bitch.  You will be targeted personally, publicly, your family, all of it."

 
Since this woman is a typically STUPID REPUBLICAN, she didn't bother to hit *67 so DHS was easily able to trace her call.  They went to her home and she ADMITTED to making the call from her home phone.  She was arrested and has been charged with threatening to kill Judge Chutkan.
