How is this not a complete overreaction to what she is doing, or in this case what she is not doing?

The judge said that fines wouldn't have worked with her. How does he know that?

Jailing her after a few stiff fines were imposed, and her not paying them,  would seem to be much more fair and reasonable.

Now, I am on the record being in favor of gay marriage, but just seems like the penalty here doesn't fit the "crime."

Thoughts?
