You obviously view the Supreme Court as a super-legislature that can and ought to over-rule majoritarian decisions and Constitutional constraints -- the elitist view -- sort of a jury of our philosophical superiors to rule us all.

You're afraid there will be a dam break of popular (i.e. democratic) laws that will spring forth from the states making everything illegal -- unless a liberal Supreme Court can keep its boot on the throat of the unwashed masses.

It's not just a strict-constructionist Supreme Court you loath, it is the majority of the people.

Now we are all in danger. With the retirement of Justice Kennedy there will be a clear majority on the court who are willing to outlaw gay marriage, anything to do with sex outside of marriage, abortion, etc.  We are in for decades of dark ages I fear. I hope I am wrong and that the effort to straighten things out can succeed.  Just watch the states rushing in with anti abortion anti gay marriage anti pornography bans confident the the new Supreme Court will uphold them.

The porn industry will not be fucked with. Moralists or not on the Supreme Court. Pussy and guns hold a lot of power.

Talking politics and religion.

With all respect, this is not of the level of  the politics and religion posts but survival of a life style that has gotten freer and more open and more honest. It is part of the above discussion of the legal challenges fully discussed above.  With a new balance of the Supreme Court we are now facing we are headed back to the bad old 1940s when abortion was back alley, gays had to hide themselves, Playboy and Eros where charged with obscenity for showing belly buttons.  This will decide if we can express out feelings and opinions and tastes in the open or must go back into hiding.  As we speak states legislative bodies like the one in Pennsylvania are tryin to override our governor's veto of a restrictive abortion law along with many other states who now have hope they can send us all back in the dark ages. Watch many of the the states now that they feel they can get state laws long understood to be unconstitutional approved by what will be the new court.

... the replacement for Kennedy is a Constitutionalist, and also moderate enough to get through the Senate?  It's possible that on the question of sex outside of marriage, Constitutionalists would see nothing in the Constitution to prohibit two consenting adults from having sex... even if one person pays the other person for sex.

I use thoughts like that (outlandish as they may be) to keep my spirits up when a lot of other stuff in the world is going to hell.

We have bigger problems than which bathroom to use. Women will still be able to get abortions, and gays can get married in Hawaii and a number of other states.
