Racketeering? For trying to win an election? Jesus Christ Democrats are stupid. Now whenever any candidate tries to have some ballots disqualified over a technicality, or if they demand a recount, instead of just sorting that out in court the other party will just charge them with racketeering. It’s fitting I suppose. Our corrupt political system finding a way to call themselves mafia dons and prosecuting each other for it shows how ridiculous they really are.  

Meanwhile the dollar still ain’t 💩, gas prices are hitting above 4 dollars a gallon, and grocery prices are going through the roof. I wish we could charge the Democrat and Republican Parties with racketeering and get rid of them both entirely.

He seems to have forgotten that Trump sued to overturn the election in several states 60 TIMES. And he lost 60 TIMES.  So then he and a bunch of actual lawyers conspired to foist several states to invent slates of fake Electors and represent them as real Electors, all while trying to convince Mike Pence he had the authority to throw out the real Electors. That's called a conspiracy to steal an election. And it qualifies as Racketeering under GA's RICO law. Not "For trying to win an election." But for trying to steal an election and invalidate millions of legally cast votes.
Rudy "Co-conspirator #1" Giuliani busted lots of people under the RICO laws who had nothing to do with the Mafia.
Meanwhile, the dollar is stronger than ever, despite Willy's delusions. And inflation is moderating, despite Willy's lies.

Maybe this will help. It includes a violation of this statute:

 
A person who …makes a false, fictitious, or fraudulent statement or representation; …in any matter within the jurisdiction of any department or agency of state government or of the government of any county, city, or other political subdivision of this state shall, upon conviction thereof, be punished by a fine of not more than $1,000.00 or by imprisonment for not less than one nor more than five years, or both.

Now think about that Perfect Phone Call to Bad Brad, to Gov Kemp, and the time Rudy went down to Georgia looking for some votes to steal. The lies they told are listed in the indictment. You do not even have to be under oath, or lie about something material, at least in this clause. Trump lied to the sheriff about his weight (by at least 30 pounds) yesterday. That’s  a crime.  

Now, I’m sure Trump will say the First Amendment gives him the right to lie. That just might work under this statute, insofar as it seems to criminalize the false statement without more. But, if not, he is toast.  

In fact, if you read all the RICO definitions, you will find that you too are a racketeer, Willy, as are all TER members, except of course for those of us who prudently were just paying for her time. LOL> The RICO statute is so broad it is down right scary.

jury instructions used in RICO cases, RICO is far from a slam dunk for the GA prosecutor.  There are specific elements that must be proven beyond a reasonable doubt, and considering all of them, I don't see how she gets there.  

 
Trying all of these Defendents in the same case is nearly impossible, because they have not all been charged with the same counts.  If a defendant inadvertently gets convicted on a count that does not apply to him, it will be reversed on appeal.  Defense counsel will hammer these required elements one by one and in many cases, the dots to not connect.

All Fani has to do is prove Trump conspired to violate this statute:

It shall be unlawful for any person employed by or associated with any enterprise to conduct or participate in, directly or indirectly, such enterprise through a pattern of racketeering activity.

 
               Most of the evidence proving this violation is undisputed and a matter of public record, if not actually recorded. The “enterprise” is the “association in fact” formed for a common purpose – i.e.,  Trump, Rudy, Sidney,  Eastman, Chesebro, Meadows and others conspired- and took many overt steps - to overturn the Georgia election results.  

           They did cut Sidney loose for a while but she came back in the infamous Oval Office meeting.

             The “racketeering activity” is the commission of the many crimes listed in indictment, including dozens of lies told to state public officials. But she does not even have to prove they actually committed the crimes – any “attempt to commit, or to solicit, coerce, or intimidate another person to commit..." will do.

 Fani does not have to prove them all– only two or more that are sufficient to show a “pattern.”

            RICO is NOT  a specific intent crime, so she does not have to prove these clowns intended to violate RICO. And apparently there is a five year MANDATORY minimum- if convicted, Trump has to go to jail for five years. Maybe he can suspend if elected president but he would still go to prison after his term. And I don’t think he will be re-elected.

            There will not be 18 co-defendants at the time of trial. All Fani has to do is say “no jail time” – or maybe “less than a year jail time” - and the small fry will come charging through the door to plead guilty and say “Trump told me to do it.”

So really, how would you defend?
