The bottom line is that, unless he is convicted of the CRIME of insurrection, Congress does not have jurisdiction to invoke Article 14. No person may hold any office under the United States who having previously taken an oath to support the Constitution who has engaged in insurrection or rebellion against the Constitution or given aid or comfort to the enemies thereof. A simple majority vote in both the House and the Senate is required.
