We knew it was illegal all along, but it took time for the justice system to catch up. Here's an article . . .
http://www.cnbc.com/2026/02/20/supreme-court-trump-tariffs-ruling.html
The followup question, which the court did not address, is whether the Trump dis-ministration will have to return the tariffs it illegally collected. I say, "Yes, they do.".

If a refund is in the cards, it'll go to the importers, not to the consumer. In the process, the budget deficit widens, as the national debt grows even more. The fed can't lower interest rates, because they need to attract money to finance the debt.

Be interesting how or if they give back the money.    The reasoning is that businesses will say "we need the money back" and while consumers will say "we paid for it so we need it back".      How will congress do this?   Or If they do it at all.

Plus add in the fact that many companies "panic purchased" things prior to tariffs being even implemented and then just "jacked up" prices.     So..... how do you figure that out?  Which will call certain companies out for price gouging issues.

The smartest thing for Congress to do is put that money into either SS fund or into transportation/education funding.   Things that already get "taxed" and you just "roll" it into those funds and distribute as a 1 time payment to the States   for the year.

Now to the ruling.....the ruling only stated Trump needs to go thru congress to implement tariffs.   So will congress do some of them but not at the level Trump did them.....ie: smaller percentages.  Will people see how the tariffs are working on trade issues and again do them but at a lower percentage.    But this is congress..... they will just kick and scream and not do a fucking thing.

What people need to know about this decision is that it is the along the same lines as the ACA mandate fine and mandate to have health insurance was shot down.  It is considered a "tax" on the people.

I don't have a scorecard, but several large retailers (Walmart? Costco?) did NOT pass along the entire tariff to their customers through retail price increases. They absorbed all or part of the tariff. Smaller retailers and importers, those bringing in one or two (or ten) pallets (rather than SHIPLOADS of pallets) of goods could not afford to bear the entire burden and had to raise their retail prices.
.
For example, Walmart buys 10 million widgets from a Chinese factory. Some Mom and Pop buys 1000 of the same widget from the same Chinese factory but with their own custom logo and packaging that says, "Our widgets are better than Walmart widgets. Ours are packaged with love. (heart emoji)" and already cost 5xWalmart.  Walmart absorbs the tariff and spreads it out across their entire corporation. The Mom and Pops cannot do that and pass along the tariff to their customers: "Due to tariffs, our widgets now cost 7xWalmart widgets."

SO.... you are admitting that many bigger companies "ate" the tariffs and didn't pass them down to consumers.

So the Liberal media LIED to us?   Is that what you are saying???

I know how buying in mass works.   It is what big corporations do and how they have always tried to kill small "mom and pop" places of business.   It is Walmart's game.     But the media and everyone told us different.   Tariffs were killing everyday consumers.... at places like WALMART.     So you just admitted that liberals were lying about the tariffs.

Now you want to talk about WAGE hikes in states.   You know Walmart's can average the increases out... where you "mom and pop" stores cant and have to raise prices to off set that $5 an hour more in wage.    Now you want talk about other regulations as well.....  You know the ones that liberals pass that help Big Corporation and kill small mom and pop stores.

Again.... you didn't make the case for the liberal talking points.

What are you talking about? It's been widely reported by legitimate media that, in some situations, some (not all) of the tariffs are being "paid" by the manufacturers, the importers, and some large retailers.  Tariffs are hurting American consumers the most but also American importers and retailers. Where do most of the US get their stuff from.   BIG CHAIN places.

Which was the Dem's battle cry of..... Tariffs are killing the consumer.    When you just proved that they were not passing it down to the consumers.

PLUS what is being found out about people "pre buying" prior to tariffs and then those people were "price gouging".

You are also ignoring FACTS of what else is hurting US retailers..... regulations (other than tariffs), wage increases, insurance increases, Work Comp insurance increases because of wages, taxes, distribution because of GREEN regulations (see CA), etc.      But yeah.... it was TARIFFS was the only thing in the news.     go back and read my threads about auto manufacturers, other retailers, booze industry, etc.      You and others wanted to paint it all TARIFFS....when it wasn't.

Now with this decision and the "refund" talks.   It will see which companies artificially inflated things.   Was it all because of tariffs, was it because of other factors, etc.      Like I mentioned the best thing would be to "keep" the money and transfer it into education, transportation, etc.  funds.

That's very MAGA of you, but you are out of touch with the majority of the country and the world. 2/3 Americans oppose tariffs. Tariffs are being passed down to the consumer - in some cases it's 100% of the tariff and in other cases somewhat less. China, in some cases negotiated about a 10-20 cut on their cost. Companies ate about 40 percent.
But companies plan on adding more to the consumer in time . China isn’t about to take anymore hits. And companies are testing how much the consumer is willing to pay to take on higher prices

You are ignore that they said COMPANIES.   Where media is saying CONSUMERS ONLY.       So out of that 90%.... how much is divided between companies and consumers?   It doesn't say.... you know why.... companies are EATING much of them or planned accordingly and bought prior to tariffs.

Also like I keep mentioning.....and proved correct when it came to cars, booze, etc.   Is that companies are raising costs because of other factors and are just blaming tariffs.   You know why.... easy to say tariffs instead of taxes, higher insurance costs, higher wages, higher beneifts needed to be paid out, etc.    you don't want to "blame your workers" or "blame your CEO's and board members for fucking up. ".... when it is easy to say ORANGE MAN BAD.

Also many of the "increase" in goods (food especially) has nothing to do with tariffs and that is where the majority of consumers are saying they are hit hardest.   It isn't the trinkets, clothing, etc that they are buying.   IT IS FOOD.  They are also saying it is energy costs and housing.    Which have nothing or very little to do with TARIFFS.    But yeah.... keep spreading the bullshit about it is all TARIFFS.

Like I said.... I am against the way he is willy nilly pushing tariffs on things.   But also understand you use Tariffs to get better trade balance and deals.    But yeah.... keep spewing bullshit dem talking points.
