Not knowing which court case exactly this one is (there are many that are fighting Birthright EO).
Is this ruling going against how the injunctions are being used/handled? Which the supreme court ruled on some of it but not all of it.
OR is it the actual birthright...
OR both?
But my take on the birth right issue.
Trump/Republicans are correct to a certain extent about "jurisdiction there for of". Which means country of origin or "citizenship". If you disagree with that. Then answer me this. Can an "illegal" immigrant face the DEATH PENALTY in the USA? Can they be sentenced to death in a state that has the death penalty?
The answer is NO. You know why.... They don't fall under the "jurisdiction there for of" when it comes to capital punishment. BUT....they can serve life but not face death. Honestly make that make sense.
So like I stated Trump is correct to a certain extent.... so are democrats.
That is why what will happen is this SHOULD go to supreme court and if anything come down to... AMENDMENT NEEDS TO BE RATIFFIED type situation.... at the most complex. Or like some mentioned IF there is a dissent....that could be one of the arguments. Along with if a foreign diplomat while pregnant gives birth on US soil that child isn't automatically an US citizen. Same goes for someone on vacation. The hospital doesn't immediately hand the parents the paperwork for US birth certificate.
Anyways this is something that CONGRESS needs to handle. They have had YEARS to do it and we all know where that has gone. It should honestly be brought to the voters some how. With an amendment ratification or new amendment type thing. Either for or against. Then Congress will be FORCED to act on how to make the "dreamers" or already born here citizens or get a pathway to citizenship. You know like a "grandfather" type clause.
