Perhaps. Elle advice columnist Jean Carroll claims Trump ask her to model lingerie in the dressing room at Bergdorf Goodman and then raped her. Trump says “never happened, never met her, she’s lying ,” or at least he did until she produced a picture of him and her.  Limitations has run on assault but she had sued him for defamation for calling her  a liar.

           Another “he said, she said,” you say? Maybe not. Remember Monica and the blue dress? Jean has a black dress that she claims has Trump’s well …you know. She has asked the court to compel him to give a DNA sample.   Trump is fighting the request. But, if forced to give a sample and the results come back positive, he’s in trouble. Look for a big settlement and non- disclosure agreement.  

             You may ask, why did Stormy Daniels –represented by Mike “why can Trump extort people and I can’t” Avenatti - lose her defamation suit and get socked with nearly $300,000 in atty fees? Well, Trump convinced the judge he was just giving his opinion when he said she was lying about some bad guy threatening her. That won’t work here – either he did her, or he didn’t.

I just hope the test results come back in a reasonable time. Let’s pick a date at random- say November 2?

she is a dingbat. Plus what kind of idiot rapes someone in a public store where one scream brings security? This is not Trump’s style. So I initially and probably still do discount her story.

BUT, and this was the point of the post, she not only has filed a lawsuit but seeks a DNA sample. If she is lying, why would she do that? She would know the results would be negative and that this would tend to disprove her story and maybe give Trump a “mistaken identification” defense. Plus she did tell a friend about it at the time.  

And if she is lying, why hasn’t Trump counterclaimed against her for defamation? That is the real hammer he has – even if we have another lawyer who took her case on a contingency as apparently is true with the Tulsi suits, she does not have the money to pay a defamation judgment.

No he didn't rape her! And no it wasn't on an "empty" floor at BG's! It was probably in his limo or in one of his hotels but this is a "dingbat" as you said, who thinks "rape is sexy", so who knows?

Public figures have a real high bar against succeeding in defamation suits.  Heck, CNN argued that Covington student Nick Sandman couldn't be defamed because he was a public figure (because he was in the news.)  Of course CNN ended up settling out of court.   But imagine the hurdle a president would have to surmount to win in a defamation suit.

Trump for all practical purposes has no higher burden than Carroll in this case where she claims he raped her. Both are public figures (Trump is also a public official but this case does not revolve around official duties) , albeit Carroll is a “limited purpose” public figure. Both have to show that the other made the statement with actual malice, that is knowledge that it was false, or with reckless disregard of whether it was false or not.  

             Where the heavy burden comes in is when the president sues a media defendant who simply has reported what someone else says. Very difficult to show malice there.

           Leaving aside the slim chance of mistaken identity, Trump has to know whether he raped her in Bergdorf Goodman, and she has to know whether he raped her. He’s not claiming consent – he says never happened. But aside from misunderstanding the law, you are missing the point – Trump – if in fact innocent here - would not counter claim because he wants to recover damages but to provide settlement leverage and to chill other bimbos who claim that some past sexual encounter was not consensual.

That he has not done so ads some degree of credibility to her suit.

To sue for defamation if you're a high-school kid in a MAGA hat suing CNN for defamation.  Heard the settlement the kid is getting is quite substantial.  Did you hear he same thing?  This should embolden others that have been defamed by the Lib media.
