…so you can understand what I’m saying. First of all, I agree completely with you that the S.Ct. did not rule in any way, shape or form on the Temporary Restraining Order. Why? Because there was no TRO in effect. Why? Because a Temporary Restraining Order is…wait for it…TEMPORARY!! Lol!!
A TRO is usually granted "Ex Parte." That means only the party asking for the TRO presents evidence to the court. The court will issue a TRO for a limited time (14 days in Cali) until BOTH parties can argue whether a preliminary injunction should be issued.
Now let’s go back to the beginning - Texas was pissed off that the U.S. cut their razor wire to protect migrants. So Texas sued the U.S. for the cost of the damaged razor wire. Why did Texas "make a federal case out of it?" Because there has to be a lawsuit in order to ask for a TRO. Texas was saying: "Hey judge, we need a TRO to stop the U.S. from continuing to damage our 'valuable' property until the case goes to trial."
At the hearing to determine whether there should be a preliminary injunction, both parties had a chance to argue their position. The federal judge denied the injunction. Texas appealed to the Fifth Circuit Court of Appeals which did impose the injunction. The U.S appealed to the Supreme Court which sided with the U.S and vacated the injunction.
Texas’ lawsuit for damage to its razor wire is still ongoing but there’s nothing to prevent the U. S. from continuing to cut it. Texas can ask for the additional damages if any more of their precious wire is cut when the case goes to trial.
In summary, the United States obeyed two lawful orders of two federal courts but the state of Texas has willfully defied the ruling of THE CONSERVATIVE SUPREME COURT OF THE UNITED STATES OF AMERICA. This is exactly the chaos that rump and the idiots who support him want.
Finally cks, some friendly advice for you: YOU should try NOT To Opine On Matters Far Beyond Your Comprehension.
Of course, you're welcome to defend your legal conclusion that "In no way, shape or form is Texas in violation of the SCOTUS ruling on the Temporary Restraining Order." Please offer at least a modicum of evidence to support your position.
