With Roberts taking a pass on serving as presiding judge, who will the Senate select to replace him?
According to the US Constitution, “when the President of the United States is tried, the Chief Justice shall preside” — a requirement not made for any other impeachment case. As lawmakers debated the legitimacy of impeachment, the Biden administration continued to keep its distance from the issue. “Congress is going to do what Congress does,” Ashley Etienne, Vice President Kamala Harris’ communications director, told MSNBC Saturday
Other alternatives have been floated, among them having VP Kamala Harris serve as the presiding judge. A better alternative was floated by a Yale law professor, Bruce Ackerman, suggesting the fact finding portion of the trial be done in the Senate Judiciary Committee, who then present their findings to the full Senate for debate. This would preclude Harris from being accused of partisanship in making rulings on evidence.
Senate rules provide a way out of Harris’s dilemma. To understand why, keep in mind that the Constitution authorizes the impeachment of “all civil officers of the United States,” not only sitting presidents. When federal judges and other officials have been impeached by the House, moreover, the Senate doesn’t do all the fact-finding on its own. Instead, after hearing the House managers and defense lawyers give an initial presentation of their positions, the full Senate delegates the tough work of fact-finding to a special committee. In this case, the Judiciary Committee is the best group to take on the job
after the House rushed to the impeachment vote, the FBI disclosed the evidence that the bad actors were planning this riot for days ahead of Trump's speech. Trouble is, it ignores a salient fact: It was TRUMP who told them to come to begin with! He created the rally and told them all to come because it would be "wild." So he set the whole thing up. His intelligence people knew what people were planning on line. And then he told them they had to "fight" or "you won't have a country." Not to mention he also first: 1) Told Raffensperger to manufacture votes and was snubbed. 2) Tried to get Clark to have a coup at Justice and failed. So this was his final gambit. He's guilty as sin.
