Neither you nor I know what the ACTUAL vote count was in Florida, because the process was flawed in several ways, and never completed in it's entirety. There are several UNOFFICIAL organizations who claim to have completed it, but they don't agree with one another.
I personally never supported denying the ballots of anyone in the armed forces. And Al Gore's team made an PR and moral error when they did so, but no more severe an error than the Bush team made when they had Jeb Bush and Katherine Harris disenfranchise several minority communities. As I said, neither you, nor I, nor anyone else will ever know what the vote tally ACTUALLY was in Florida, because the Supreme Court specifically decided to shut down the tallys so as not to risk Bush's supposed victory.
You may not LIKE his rulings, but Scalia's legal resume is one of the top in the country. So since you have made the above argument, make your case Counselor (legal terms, please, not just that it was a stupid ruling)
