The standard is based on whether or not a fetus can survive on its own outside the womb. This is generally held as no earlier than 30 weeks although medically, a human born 10 weeks premature is very likely not going to survive and if he does he’s not going to be very healthy or have much quality of life.
The GOP plan to ban abortions after 20 weeks is based on the medically and scientifically unproven theory that a fetus will start to feel pain at that gestational mark. This is purely an emotional and arbitrary standard that has no place in becoming a law. Most states and European countries ban late term abortions after 28 weeks anyway so it’s just further politicization of the issue to make the thumpers feel better. Ireland basically does not allow abortions at all.

the GOP is introducing a common sense European style bit of moderation into the Abortion debate. In Europe, early abortion is widely available, but is increasingly restricted to outright banned at later stages, due to the widespread common moral sense that as the baby grows and looks more obviously like a baby, the more it deserves protection in its own right. In America the abortion debate has been waged in all or nothing, extremist terms from the beginning, because the activist Supreme Court, in making up stuff obviously not actually in the Constitution, took the topic out of the zone of Democratic Compromise and into the sphere of absolutes. Roe holds, as actually implemented, that the government can do almost nothing to protect the rights of a baby up to the moment of its birth. No where else in the world, including in the Progressive dreamlands of socialist Europe, does anyone think it makes sense that it is only up to Mom and whatever she wants even at 9 months full term... but in the USA that is the normative position of half the political spectrum. Name a single state in which abortions after 28 weeks are banned. In the US, no abortions are banned right until the point of delivery, if the Abortionist and the mother agree. Yes, partial birth abortions, a method not a gestation point, are banned, but that's it. What a Whopper. Oh, but you're right, the important point is a few weeks here or there in compromise positions attempting to reconcile, if poorly, the desires of women who wish to abort and the intersts of babies in not being aborted.... not the gaping chasm between that and the All Abortions On Demand For Any Reason Up to Delivery (the American Left Position)
There are are only 7 states including Alaska that do not ban abortions after a specific term. Several already ban after 20 weeks. Some ban after 28.
