Penney was NOT charged with murder and was NOT in a "fight for his life." He was charged with criminally negligent homicide, which is an elevated version of manslaughter. Oh, and there's no death penalty in NY, so even if he'd been charged with murder he wouldn't be fighting for his life.

Actually the issue they are trying to make is this.... People are now afraid to step in to help others for the fear of what will happen to them LEGALLY because of lawyers.  Penny stepped in to help and afterwards was in a legal battle for his life.   YES FOR HIS LIFE.  Possibility of going to prison, his reputation, losing his job, media attention, etc.   All because of a person was threatening people on a train, threatening himself, etc.  He moved into action to subdue the man..... it wasn't "careless" or "recklessness".   Since after doing the chokehold he and others tried to render aid.

 
But this shows you what the OP is talking about with lawyers.    PLUS the political climate trying to make it about RACE right away.   Also about people not helping family members or others refusing help with substance or mental issues.   There is more than enough facilities, aid, etc out there to help from the government and private sector.  It is just a matter if people want to do it or accept that help.  

I will first note that snafucked has so far not even tried to defend his playing fast and lose with the facts. I guess he was waiting for you to do it. As for Penny's actual actions, do you really believe choking someone to death isn't "careless" or "reckless?" Another jury found the killer of George Floyd guilty. So there's that.

I don't think it was reckless at all.   The guy was making threats against everyone in the area.   He stopped the threat.   Chokeholds are meant to be "non lethal" .   He didn't shoot an unarmed man.   Then he did render aid after the fact he went unconscious.

 
Now you bring up Floyd.... we could go 10000000 pages on this whole fuck up on all levels.  Chauvin was hung out to dry..... I honestly don't think Chauvin got a fair trial.  Lots of stuff coming out on how witnesses lied, judge didn't allow evidence, etc.  Then other officers got fucked over as well.    Should have Chauvin got charged with something.... YES.   To what extent is debatable.      Reasons why is this...

 
1. The technic used WAS taught (witness lied).
2. Drugs in system of Floyd (did it cause death debatable)
3. Should have Chauvin rendered aid quicker YES (knee off sooner than he did...ie: where charges needed to happen)
4. Other officers were doing crowd control and couldn't see what was going on (how they got screwed over)

 
There are more... like I said... could go on and on for both sides of argument.   But the big one for me is the other officers had their backs to the situation because they were trying to control the crowd the majority of the time.  They were the ones who got screwed over.

 
Anyways.... back to Penny.    The DA's and attorney's now go after anyone and everyone especially when "race" is involved.   People are looking to make headlines instead of going with FACTS.   Hell look at the case of the stabbing down in Texas of the kids in the tent.   Look how quickly that disappeared once evidence started to come out and vids.  Same can be said about many others.   EVEN Self defense ones.    It is sad that the self defense stories or people helping others are not celebrated.   There are actually many stories of black kids or youth's stepping up helping others in need than white kids out in the news.   The sad part is those are here and gone in a day with the news cycle.  Those need to be celebrated for weeks.   Governors need to hand out awards for that shit.

Third......  Floyd's case was so fucked up it isn't even funny.   So many things wrong with it.   YES Chauvin should have been charged but what he got wasn't the correct charge.   The Judge fucked up by not allowing certain evidence into the trial.   Witness's lied.... the hold was taught and used correctly.    The other officers got screwed over because they were doing crowd control and couldn't focus on what Chauvin was doing.  YES Floyd did have drugs in his system and that should have had more weight into the verdict.   YES Chauvin should have rendered aid quicker and took his knee off of Floyd sooner.   The list goes on and on.    The court system FAILED on this one big time.   This is a case that they didn't want more riots to happen and the bigger optics played a role than actual justice.  

 
I will repeat Chauvin deserved charges but not what he got.   In a previous case in MN a Somalian officer shot and killed a woman who was walking up to him to report the crime the police were responding too (she called it in) and he only got 3rd degree murder charge.   SHOT AND KILLED.....Chauvin got 2nd degree murder.... for doing a restraining hold.    See what I am getting at..... He shouldn't have gotten the 2nd Degree charge.   The involuntary manslaughter.... yes... just a matter to what degree.   Especially since he didn't render aid right away....ie: body went limp.    The difference between Chauvin and Penny is that Chauvin receives regular training and Penny doesn't or didn't.    Being in the Army or once the Army compared to active police on duty.

Those two holding Floyd down could clearly see what Chauvin was doing.  The officer holding Floyd’s legs had only been on the force for FOUR DAYS yet he knew enough to ask Chauvin if Floyd should be moved on his side.  Chauvin said “no.”

going back to the OP and the murder in Charlette where everyone in the train turned a blind eye as a guy took out a knife, stabbed a woman, walked around a train and then exited.   Nobody tried to stop the man.    

 
On the Floyd issue....
There was more than one officer doing crowd control.  When people keep showing up and getting aggressive it is police officers job to control crowds and worry about officer safety.    Look at the film of people trying to get around officers, screaming, etc.  Officer safety was becoming an issue.  Also underlying condition that many don't know is that neighborhood environment.  Which local PD does know.  Which was also not allowed in the trial.   But again.... facts that locals/people from MN know about.

 
Choke holds are "non lethal".... otherwise why would they be allowed to be used in MMA?   Why are they taught as a non lethal self defense move.

Justine Demond did not walk up to the cop that shot her.  It was worse than that for several reasons.  The DEI hired somali recruit was sitting in the passenger seat and she walked up to the officer driving the car on his side. The DEI hired somali cop pulled his weapon and from the front passenger seat, fired his weapon at and fatally hitting Justine Demond with the other officers head in between the gun and the victim.  The trajectory of the round came within 5 inches from his face and was about 14 inches away from the other officer's head when fired.
