Act 1. On or about the 4th day ofNovember2020, DONALD JOHN TRUMP made a nationally televised speech falsely declaring victory in the 2020 presidential election. Approximately four days earlier, on or about October 31, 2020, DONALD JOHN TRUMP discussed a draft speech with unindicted coconspirator Individual l, whose identity is known to the Grand Jury, that falsely declared victory and falsely claimed voter fraud. The speech was an overt act in furtherance of the conspiracy.

Act 2.  On or about the 15th day ofNovember2020, RUDOLPH WILLIAM LOUIS GIULIANI placed a telephone call to unindicted co-conspirator Individual 2, whose identity is known to the Grand Jury, and left an approximately 83-second-long voicemail message for unindicted coconspirator Individual 2 making statements concerning fraud in the November 3, 2020, election in Fulton County, Georgia. This telephone call was an overt act in furtherance of the conspiracy.

Act 3.  On or about the 19th day ofNovember2020, RUDOLPH WILLIAM LOUIS GIULIANI, JENNA LYNN ELLIS, SIDNEY KATHERINE POWELL, and unindicted coconspirator Individual 3, whose identity is known to the Grand Jury, appeared at a press conference at the Republican National Committee Headquarters on behalf of DONALD JOHN TRUMP and Donald J. Trump for President, Inc. (the "Trump Campaign") and made false statements concerning fraud in the November 3, 2020, presidential election in Georgia and elsewhere. These were overt acts in furtherance of the conspiracy.

Act 4. On or about the 20th day of November 2020, DAVID JAMES SHAFER sent an e-mail to unindicted coconspirator Individual 4, whose identity is known to the Grand Jury, and other individuals. In the email, DAVID JAMES SHAFER stated that SCOTT GRAHAM HALL, a Georgia bail bondsman, "has been looking into the election on behalf of the President at the request of David Bossie" and asked unindicted coconspirator Individual 4 to exchange contact information with SCOTT GRAHAM HALL and to "help him as needed." This was an overt act in furtherance of the conspiracy.

On or about the 20th day of November 2020, DONALD JOHN TRUMP and MARK RANDALL MEADOWS met with Majority Leader of the Michigan Senate Michael Shirkey, Speaker of the Michigan House of Representatives Lee Chatfield, and other Michigan legislators in the Oval Office at the White House, and DONALD JOHN TRUMP made false statements concerning fiaud in the November 3, 2020, presidential election in Michigan. RUDOLPH WILLIAM LOUIS GIULIANI joined the meeting by telephone. This meeting was an overt act in furtherance of the conspiracy.

you'll see in that rogues gallery the nominees for "unindicted co-conspirator #3." One good candidate is Joseph DiGenova (or his wife). As for the Nov. 20 Oval Office meeting, it's pretty likely the info came from the White House counsel. Noteworthy here is that said person is not listed as an unindicted co-conspirator.

"But in the Georgia case, Mr. Trump would have no such power if he is re-elected, because a president’s pardons apply only to federal crimes.

Beyond that, getting a pardon in Georgia is not just a matter of persuading a governor to grant clemency. People convicted of state crimes are eligible to apply for pardons only five years after they have completed serving their sentences. Even then, it’s not the governor who decides but the State Board of Pardons and Paroles.

And while criminals can ask the parole board to commute sentences right away, the board “will consider a commutation of a sentence imposed in other than death cases only when substantial evidence is submitted” showing “that the sentence is either excessive, illegal, unconstitutional or void” and that “such action would be in the best interests of society and the inmate.”
IOW, if Trump is convicted in GA he's fucked.

as applied to a sitting president.  I see a lot of talking heads clucking that Trump cannot self-pardon himself out of this one but they are missing the point because the mandatory minimums of any  Georgia criminal statutes would be unconstitutional as applied to a sitting president. Quite simply, he can’t perform his Article Two duties from a Georgia prison cell where inmates cannot make phone calls, their “mail” is read, lights out at 9, and they are required to work on the chain gang, or whatever they do in Georgia post- Cool Hand Luke.

I suppose the counter argument would be that, if Trump cannot discharge his Article Two duties because he is in the slammer, the duties devolve on the vice president. So now the Commander in Chief is – Marjorie Taylor Greene? Or maybe Lindsay Graham is playing the long game here. But I don’t think we even get to this point – I think it is an easy call for SCOTUS to say the criminal statutes fall during the presidency.  

My sad prediction - he won’t serve a day in prison if convicted, at least for the next four years.

It is well documented that Trump won Coffee County, GA in 2020 with 70% of the votes. It is equally well documented with video surveillance, testimony, and other evidence that Trump Republicans were illegally given access to the voting machines on Jan 7, 2021. They copied a lot of data and software, all done illegally. At the time (and since), it was alleged that they were looking for evidence of vote tampering and the shifting of Trump votes to Biden. What? Coffee County was solidly Trump and Trump got 70% of the vote. Shouldn't you be looking in counties where Biden won? Well, ...

A talking head recently suggested that the Trumpers were NOT looking for existing voter fraud, but were looking for a way to shift votes TO Trump because they "just want to find 11,780 votes, which is one more than we have, because we won the state." IF they could have figured out how to do that in Trump friendly Coffee County, they could have gone after voting machines in other counties, such as those that Biden won, and "found" the needed votes.

in cleaning up New York when he was a Federal prosecutor, because when you are guilty and know it, it's a sledge hammer if you are convicted, but Trump doesn't believe he is guilty, so RICO doesn't scare him at all. It's a pretty high bar to get a conviction unless there is no "doubt" whatsoever.

to declare his guilt to each judge, but instead said, "Not Guilty."   There is it from the horse's mouth.  

 
He's now polling at 59% in the primary and his lead is growing.  Not a lot of room for pants-shitting with those kinds of numbers.
