If the claim is bogus they will throw out lawsuit related to it.  There detailed steps in securing evidence(chain of custody)  for computer crimes, order of preservation due to order of volatility.  Everything has to be documented. There is a difference between real evidence, documented evidence, demonstrative evidence, and real evidence. Circumstantial  or hearsay evidence can't be used.  For the accused there are requirements for exculpatory evidence if they did not commit any crimes.
